Canadian Defaulter Sent ‘Back to dail. The George Enger’s Common-Law Wife Comes Out Ahead, Full Record of Proceodings In tho Cook County Courts. IN GENERAL. ESCOTT REMANDED. The habens corpus case of Matthow I. Escott was heard yesterday morning by Judge Barnum, and deelited at 2 o'clock. Escott was formorly Cashier at Moutreal of the Canada Investment & Agency Company, and managed to get away with about $13,000 of the funds, Ho came to Chienzo, where he was recently discovered, and a suit brought agalust him, and a caping also fssted on which ho was arrested. Judgment was recovered against hin about ten days ago for over $17,000, nnd he was renrrested on n eaplas nd salisfactondum, Being unable to find any one who lind that much con- fidence In him, fe was obliged to go to jail. A petition for habeas corpus was then filed on purely technlenl grounds of want of suficioncy of the nfidavit, error in date, ete., and lenrd yesterday. Io claimed that his confinement was illegal by the strict words of See,5 of Chap. 24 of tho Revised Statutes, which statute is ns follows: “No exveution shall Issue against the body of the defendant, except when the judgment shall have been obtatned fora tort committed by such defendant, or unless tha defendant shall have been held to ball upon a writ of caplas nd satisfaciendum as provided by law, or-he shall refuse to deliver up his estate for the benelit of his creditors.” Judge Barnum sald the above section un- dertook to define only three classes of cases in which tho Iaw allowed an execution against the body of the defendant, The judgment against Escott was founded ona elalm or debt, and tho afidayit on which the judgment wns based showed the debt had been fraudulently obtained. 1t was a clear enso of embezzlement, as far as the record showed, The judgment, therefore, was not for tort, but was embraced In the second class of cases mentioned in tho statute, The clause in thestatute contained a palpnblo mis- take in language. If tho word respondendum Instead of satisfactenduin had been used, then it was admitted that a en. sn, could have been Issued, Whether that error vitinted the statute would be shown from an analysis of the clause rulating to the second class of enses, ‘Tho words to bo considered wero “a defendant, shall have been held to bail upon a writ of capins nd satisfaciendum as provided by law, Only one legal mode was provide for gutting any person bailed when ho had been arrested on a writ, and that was explained Inthe chapter on bail. ‘That evi- dent blunder in Sec, 5 could be entirely obvi- ated by rejecting the surplus part of the clause and retaining only so much as was needed tumake perfect sense, The only mode by which a man could be sent to fall In sucha case was by eaplas ad respondendum. ‘The words then In the statute “upon a writ of capins ad satisfaciendum” could be stricken out without doing injury to any one. ‘The object of the law should not be defeated by asimnplo techniculity, and tho petition for re- lense, so far us it rested on that ground, could not stand. As to the other allegations, that the affidavit on which the writ was based was yold beenuse dated 18780, Instead of 1880, the Judge held. thnt, the first eapins having performed its office without its sufficiency belng questioned on the prellini- nary hearing, it must now be held to be valid ns far as the present action was concerned, ‘The Court now could not go back to the ori- final caplas when'Escott was not held under {, bué under a capias ad -satisfaciendum, the latter being all-the Court could look into, As it hind not been shown that the defendant had not obeyed tha third direction in the stntuto by. aweurlng out under the insolvent debtors’ net, no cause was shown, justifying his release, and he would accordingly have to be remanded to jag. ¥ P.
