George A, Gibbs and JT. O, Me- Dald appeared tor the State, and F.C, Rusecll for the prisoner. The return of the Sheriff wae rend, showing that, BUYDAM WAS DBETAINED ON A CHARGE OF ADULTERY. ‘The Judge sold this was vo erlme under the statute, and that the warrant was insuillelent to give the Court Jurisdiction, The statute provided that an indietmont might be had against partles Iving {nan apen state of adul- tery, but the commission of the offense once was nocrime. Nor was {to sufileiont charge to nold a party until trial.
