== TIE COURTS. Oonflict Between Judge Blodgett and Justios D'Wolf. The Other Side of the Sonth Park Spe- cfal Assessment Cases Record of Judgments, New Suits, Probate Business, Bio. The ovinlon In the case of tha Lake SBhore & Michigan Southiern Rallway Company ve. H 7is Goldberg waa filed yesterday In the Appel- Jate Court. This was a sult lo trespass azafnst the Lako Bhore Road, the Unlon 8tar Line, E. A, Cornwell, aud Reuben Blayton, aud plalutif charged assault and falee lmprisonmest and dsmages. It secme that the companles hsd reason to suspect Uoldberg of stealing goods from their ofilces, and Cornwell, s agent of the Lako 8hore Rodd, aucd out & search-war- raut and had Goldberg’s house searched. The caso bas been tried four times,~resulting first fua verdict for oue and then for the other party. The Lake Bhore Rosd dissvowed ths sats of Cornwell In the matter, yet on une trisl the Jury found Cornwell lunocent and the Com- pany gullty. Judge Pleasants sald the liability of the Lake Stbore Road wmust havo arisen as principat of Cornwell, who, in suing out the .search-war- rant, committed the trespass complatoed of. The Court below crred in not admitting on the 1ast triat the record of the former trial. 1t the trespasscs wero the ssme in both suits, no ob- Jection could be made to the record, except that 1n the prescut class of cases a Jjudgment In favor of one defondant, jofnt or several, was not in Jawa bar to tho actlon against snother. But that rule was inapplicable in the present in- stance. The former judgment was not sought o be ploadea as o bar, but, in connection with other things, as part of the dgfense. The Lake Shore Road pleaded the scquittal of moother defendant, and that 1t ltsclf was only sought to be charged through the scts of that defendant, who had been acquitted, and the record of the ncquittal ought to have been ad- mitted for such purpose. Where the real actor, nooc the less llable personally be- cause acting for snotber, was fonnd not gullty, it followed that the party for whom ho wasacting could not be guilty. The principal could be no more guilty by aam act of his agent thao if ho had committed the act himself. Ths Compsoy waa & corporation, and from its nattire incapa- ble of cotnruitting a trespnss except through an sgent. ‘Che record, which was excluded, tended 10 shiow that tho scts charged againat Cornwell, of wbich ho wns found not guilty, were the same dmfli d nat the Company in the pres- ent sull t was a part* of the Cumnm{'l do- fense, and its exclusion was error, for which the judgment would be reversed and the cause re- manded.
