Judge tlovey to-day decided that the third count could not legally be amoended at this stage of the case, and consequently it is thrown out. The Court suid, as to this vount, that the proposed amendmwent tnakes this count practl- cally a vew indictment, and that, If the defense bad not taken cxceptions, he would, in charging the jury, have felt it a duty to charge that Bo case had been proven on this count, because the esscntial part of the allequtlon Lad aot been vroven,—that is, the existonce of u corporation whose policy-holders were allegod to bave been decelved and delrauded.
