Tt was stated that the Audl- tor-General would Issuc his warrant to-day, snd the Court was sought to Intervene to prevent it, it possible, Counsel for the road sald that, when tho Court suthorlzed tho Recelver, & tmonth ago, to {ssuo o preferred certificate to ralsa moucy Lo pay thesa taxes, they thought the money would be raised within the prescribed thirty days. Judge Brown sald that, at the time, he hod lttle doubt of his power to muthorize o preferred certificate subrogating the holder to the rights of the Btate. Since then he had laid the matter before the Cirenit Court who fully indorsed bis actfon. 1n view of this fact, he thought some of the banks would furnish the nioney to poy theso taxes, and thus save the road from golng under the hammor, very much to the detriment of the ordinary certificate- holders. Counsel for the rond thought that, backed by the opinton of the Circult Judee, they could ralse the monoy within the next two or three days, Attorney-(ien- eral Kircbuer sald there was no disposition to oppress the road, but tho State nceded and must have Its money.
