Bwenyel va. Dr. David F. Bweneel, for scparate mainte- pance. In the biil Mrs, Bwengel charged that she was married m Mareh last 10 the defendant, put that he had refused to recognize her as bis wite, though he bad repeatedly visited her and lised with her since. Bho boro bore him a child inJune last, but he refuscd to give her any support untll sbo signed some papers tending tothrow a cloud on the legslity of her mar- riage, and shie now claims such papers were ex- torted from her. B8he claimed he was a dentist iu good practice, and well able to support her, sod asked for a separate malntenunce. DR. 8WENOEL flled an answer denying that he ever married somplainsnt, whose real name §s Mary L. Gino- ctfo. Mo stated that he was {ntroduced to her (o the spring.of 1877at the Cllfton liouse, whero they were both boarding, and {n October follow- {oglent her 850 at her request, Shortly after- ward, on the representation that shie was ox- pecting remiltances from New York, he indorsed two notes for 8160.28 for lier, payable to Mun- cer Bros. & QGray, proprietors of the hotel. These wero for her board, and ho bas sinco been compelled to pay them. In March Inst she swore otit o warrant sgainst him on s eharge of committing rape, aod he was arrested about 8 o'clock in the eyening and tuken to Burke's Iotel. Thero he met Mrs. dwengel and a minister, the Rov. Dr. Everts, who had a liccuso fu dus form, but procured without his knowledze. She demanded that e marry ber, and an excited conversation fol- lowed, during which she swooned. He caught ' her in his arms, und while in thissattitude, but without consent and against the protests of this defendant, the safd clergyman uttered somo cercmony snd pronounced this defendant and the sald complainant husband and wife. MRS, BWENGEL herself, an exceedlngly dignified, preposscesing Iady, who confeascd to being 44 years of age, but looks rather older. Bhe testitied that she waa first married In Now York to one Cornelius R. Totten, and was divorced In 1878, Bl had by him tbrec children, two of Whom, respectively 18 and 24, were now living. the cami to Chlcage about two years o, and lived first at the Paliner House, then the Grand Pacifle, oud, lastly, the Clifton. Here Mrs, Swengel'a tcnflmonfl was ioter- rupted to put on the stand Constable Eckert, on the part of Swengel. He tustitied that he ar- rested Swengel on s charge of rape, and took him to durke's Ilotel, where he sawv Swen- wel and Dr, Everts. Ile was requested to re- tire, and did so for an hour, and then went into the room where they were, e heard Bwengel say, ** 1 can't, I cant,” at the samo tine waving his hand. Mrs, Swongel fainted, or lBuenmd to fulut, Swengel caught her, and then Dr, Everts vronounced the marriage ceremony. In the afternoon Mrs. Bwengel took the stand again, and the cross-examination wus coutinued by Gen. Stiles. The lady was asked about varl- ous auns of money which the defonse contend- ed she had rocelved from Swengel, but her ex- planstions wero quite unaatls| rnczurly—nt least at this stagre.
