Record of Judgments, New Suits, Bankruptcies, Ete. APPELLATE COURT. NELSON VS. THR C, B&Q ‘'Vhe case of Murry Nelson & Co. va, The Chi- tsgo, Burlington & Quincy Railroad Company {ovolved an important question of the right of sconsignor to stop zoods in transitu wheo sent to his consignee. Tho facts wero, In Urtaf, as follows: In 1874 Murry Nelson & Co., commie- gion merchants, of this city, made aa arrange- ment with Richardson & Bon, country grata merchants at Streator, by which the former wero tw supply tho necessary funds to enable Richard- ton & Son to buy grain aud shipit here, tobe sold for Nelron & Cu.’s profit, Uniler, this arrange- ment larze’quantities of grain were bonght and ah!pped, Richardson & Son drawing drafts with bilis of Iading attached, on appellants, aa faxt as they sbipped. Sometimes, however, the grain purchascd was kept in the warehouses of Richardson & Co., and at such tlmes the drafts drawn were accompanied by warchouse receipts of the Richardsons. About the 20th of October, 1875, the Richardsons owed Murry Neon & Co. about $5,000 on ae- count of advances, and the latter, be- coming fseatisfed, ecnt on an agent to compel Richardson & Son to forward the grain evidenced by the warchonse recelpta they had tssucd. The agent, on teaching Streator, sur- rendered tho warchousfreveipts he held, and Joaded all the cars be could get with grain from the Richardsons’ warehouse, the owners mak- Ing no opposition. The cars not being suill- tient, he telegraphed for and obtained four nore, which were loaded and consigned to Nel- Baturday, the 2 of October, the First Nattonal Bank of Streator caused to be gntered up Judgments by confession judgment ootes, and {nimediatcly pro- mred executions to bo fsaned, and on the Monday foltowlng the property of the Richardsons’ waa acized on these executions. When the grain arrived in Chicago, Nelson & Co. eemunded it of the railroad coinpany, and on the latter's refusing to deliver they began a replerin sult, but were defeated, and appealed. The judginent of the Court below would, therefore, be afllrmed. ; Tus POWRRS OF CHANCBRT IN cheDiToRe’ BILLS, the enee of the Potladclohta Fire-Insar- oe Company vs, tho Central Nattonal Bank and others, decided by the satne Court, a ques- tion of practice was raised a6 to the form of action against certain insurance companies. It seemathatin January, 1875, the Central Na- thonal Bank recovered judgment for $4,773 against A. K. Norris and the Norris Planing- Mil & Lumber Compans, and, failing to find property with which tosatiaty theexecution, fled acreditor'’s bilt, Some of the nroperty it was songht to reach wes a planing ruil standing in the name of Mra, Norris, and pending the {ti- gation the mill waa destroyed. It was insured, and the !naurance companics were subsequently made partion to the creditor's bill, and it was sought to make then pay over in that form of action the amount they owed the owner of the mill. The instrance ‘companies appeared and urged that they wonld not be deprived of thelr tight of tefal by jury, and that the prover furm to make them responsible was by action at law. The Court below, however, entered a decree against eavh company for the amount due on Ita policy, and the Companies appealed. ‘The Appellate Court, Judge Butluy delivering the opinion, said the princinal error urged was as to refasal of the Court balow to refuse to remit the question of the lability of the Ine surnuce companies ty scourt of law, 49 of Chap. 2% of tha Revised Statutes of 1874 provided for the bringing of a creditor's bill to compel alcavery, ate., and for w decree to com: pel payment of the amount due vut of the property discovered, Althongh = creditor's DL was a bill for retief, yet the rellef seemed dependent on a disenrary. Hoard of Education, Affirmed, ‘This case involved the question as to the legal- ity of the'Rosrd of Education. The suit was to recover the back rent, amounting to ow: ing by Milter & Doolittle, os lessees of dock property on the South firanch, near Harrison street, which belonged to the Schuol Fund. The principal defense was that the Board of Education was not a legal cor- poration, and could not bold or lease property. A demurrer was interposed on the pround that tho Iceaces, haying accepted the lease, were estopped from calling in question the title of their landlord. The Conrt below decided in favor of tho Board, and the Appel- late Court affirmed the decision.
