Allen’s Trading in Murphy’s Paper Pronounced Valld by Judge Harlan. Condit et al, Town Officers vf Lako, Deny All Charges of Mal- foasanco, New Suits, Bankruptcies, Di- vorces, Judgments, Ete. Jack Bturges {8 well known on the Board of Trada as a manipulator of corners,—nud algo to mavy a8 on operator wlio don't pay tho differ- ences lost on his corners,—but yesterday he blos- sometdl out as a successful operator of & legal corner. Saturday Judgo Rogers overruled the motion for s now trial In the mandamus case, brought by Blurges agalnat the Board of Trade, and ontered judgmaent {n Bturges' favor, but immediately noutrallzed all tho immediate ad- vantago hoped to b derived from It by granting an appeal and decldiox that the appeal operate 88 o supereodenss Not liking to livoa curbstono brokoer for a year or two longer, until the Bupreme Court passed on tho case, Btarges, or rather bis able attorncys, Judgo Beckwith and L, G, Pratt, do- vised a new scheme, which was succesfully car- ricd fnto operatlon yeetorday. This was the Oling of a new bill for Injunction tepprovent tho Board of Trade from keeplog him out. Blurges, fo this bill, after civing tho Board a very com- plimentary notice, tot, it may bo safoly averred, out of any speclal good will to that corporation, but rather to st off tho magnitude of his loss, gocs on to say that in 1870 ho became o member of tho Board and has pald all dues up to Jan. 1 last, twhen the officers of tho Board refused to allow bim to contribute sny more to Its support. Complainant's only means of ivelthood 8 by his commisalon busiucss,—dentlog fn graln,~and, as the mem- bera of the Board have practically a monopoly of that business in tho City of Chicago, if hels doprived of his rights on tho Board he ls virtu- ally doprived of his mcans of- carning a living. Starges then goes on to give o history of the charges made sgatnst him In November, 1874, of tho taking of thoe vote, cte,, and clalmd that tho charges werd not provoni that he was not allowed to be beard in his defense. The proceedings to expel him were stopped by an injunction sult, and were locked up until last January, when the Bupreme Court dismissed the sult. The Board then concluded tha election, snnounced the count, and declared Sturies expelled. Sooa after he filed s petition for mandamus, which was heard n short time ago, and a verdict rendered declaring tho expulsion {liegal. In conclusion, Bturges states that it has been eatablished by trial at law that he was wrong- fully expelled, and that, although his riclit to bo re-established has becn declded, yet by rea- son of dn appeal by the Hoardfand of the re- fusal of the Circuit Court to prescribe os a con. ditlon of the sppeal bond, that he should be re- admitted to the grmlnuen of the Board, ke s stiil unjustly and wrongfully kept out of the enjoyment of s rights until the appeal is de- torinined. Owing to the pressure of buaincas in thoBupremo Court this will not be for at least two ycars, and, In the meantlne, ho thinks he wiil sustain frréparable loss, fle has ap- led to the Board to remstate bim, but they Havu refused, and he thoreforo asks the Court to Interfore and rostrain the Board frum ro- strafning b from exercising his right to avcculntn on 'Change again a8 ho was wont to 0. . It appears that Sam Walker floated sotne of his paper on the market fn 1569, and scured it by two trust-decds,—one to the Fourth Natlonal Dank and the other to some other partics, tbe latter being the first mort- roge. When it came due, Walker raised part of the moncy, and borrowed the remainder of Urecnebaum & Foreman, and took up the note and trust-decd aud tumed them over to baum & Foremmu s security, ‘ourth Natlonal Bank held a mortgage on the same property, oud sought to buve the trust-deed beld by 0. & F. sct uslde, ou the ground that it had been pald, aud was vold as agalust them. The Fourth Natfonal Bank taklug thelr security after Greoncbauwtn & Foreman had acquired ! rlghts could not say they had suffered any e, aud had no right to_ask to have the security disturbed.
