That Body Also Passes the TFicheries Commission Award Bill. POTTER’S COMMITTEE. A POOR DAY FOR THE INVESTIGATORS. Special Dispatch to The Trivune. WAsBINGTON, D. C., June 8.—It wasa poor day for the Democrats in the Potter Commit- tee, The prepostcrons story had been started that there would be proof conclusive that the Tepublican Electoral return No. 8 from Louisi- ana had been intentionally omitted from the official report of the proceedings of the Electoral Gommission, and that the omission was part of a great conspiracy. McKenna, Clerk of the Electoral Commission, being subjected to an cxacting eross-examination for hours, explafned clearly that the omission was occusioned b 3. clerical inadvertence and the error of the official stenographer. The absurdity of any claim of fraud in this matter 15 mani- fest when it Is understood that the Dbook in which the misprint occurswas not print- ed until after the Electoral Commission had closed its labors. The original returns were ALL DEFORE THE COMMISSION and were printed. Every ‘member had a printed copy of each of the returns, and toe ‘manuscript origipals were constantly upou the Clerk’s table, The theory, therefore, that there was any attempt at conspiracy was absurd. The Demo- crats have lost this poiot, which was only one of many petty technical points that they are seck-" ing to raise. They were not more successful with Senator Ferry. They had hoved to find in the man who had conrage enough to count the votes if it bad Dbeen necessary a person who would either nc- Puowledge himself to have beena party to & great fraud or would have become 8 recusant witness. 'SENATOR FERRY DID NEITRER- Havine first obtained permission of the Sea- ate to answer the request of the Committee, he esplained in the minutest detail bis connec- @ion with the Electoral returns to the acknow!- edged satlsfaction of the Democrats. He thowed with what signal fidelity the Republican President of the Senate ad- ministered the duties of his great office in that eritical time. ‘The statement which Ferry pre- sented as to the irregularities in the returns of the Electoral Cotleges of all the States should be regarded by the American people as & warniu that speedy revision of the Election Jaw is necessary to prevent the recurrence of another Electoral excitement. Senator Ferry took the precaution to have kept a record of the irregularities made by the Electoral Colleges. There WERE NEARLY TWENTY STATES in which there were some deviatious from the statute requirements with respect to the out- ward formalities of the vote. Democratic and Republican States were alike. The Democrats have sought to make 3 poiut against Ferry, from the act that the first messenger return which came from Loulsiana was allowed to be taken back for correction, but it appears that the re- turn {rom Democratic Nortn Carolina was also taken back to that State, and Was 1eturned cor- rected, and Demoeratic Arkansas even endeay- ored to induce Vice-President Ferry to allow. the returns of that State to be taken from hits, custody, for correction, after he had officially received it. Ferry showed thatthe original, genuine return from Louisiana was first re- B eived by mall, was first prescated to the joint Coovention, and Was submitted to the Electoral Commission. LBVISSER asked to be recalled, and rebuked one of the Democratic members of the Committec for having put words ln his mouth. The Demo- cratic members conduct the cxamipation sO much like a prosccution that witnesses feel sensitive at it. This sensitivencss Was maok- B Yo-day by Mr. Cox on bebalt of the Re- publicans. Cox rebuked McMahon for acting as a prosccuting attorney, stating that ac- read In full in the Commission, but were or- dered printed, and, at bis (McKinncy’s) sugees- tion. the certificates were printed in the back of the book coatalning the record of the proceed- ings of the Electoral Commission, and, at the suggestion ot Mr. Garfield, he rezently com- pared said certificates, finding that they bad be- come mixed and were duplicates. The witaess continued: The Commission dealt only with the printed papers, except in one or two instances. Could uot explsin how the certiticates became MIXED AND DUPLICATED IN THE PRINTING. During the examipation by Mr. McMahoo, Mr. Cox accused him of assuming that he was counsel for the prosecution; whereupon Mr. McMahon said that Mr. Cox was mistaken, and that he (Cox) was assuming a role entirely for- ¢ign to him, namely, u defender of fraud.’” At the request of the Chairman, the examina- tion proceeded, and the witness stated, in reply to questivns by Mr. McMahon, that when Gen. Garfleld came to him inquiring into the matter (the mixture of the certitcates in the printed vol- umes) he said: **You will probably sec the im- portance of these in a fow days, Therc bas been some charge made that some of the certifcates were forged.” In reply to questions by the Chairman, Poster, Mr. McKinney teatified that Garield came to him in the Clerk’s office of the Supreme Court, and, to the best of his recollection, asked him if he re- membered any difference in tne Kellogg Lotislana certiticates, to wnich he replied that he did, bat 4 not recolicet what the differcnce consisted ing \whereupon, at Gen. Gerfield's request, T zot an octavo volume called **Count of the Electoral Yote,” in wilch a duplication appeared, and, \hile Gen. Garfield read Certificate No. 1. 100k vd atNo. 2, und the difference was that one of fhe “cortificates was separnte a3 to iiayes and \heeler, and the other was o joint cortificate. Tne certificates, the witness stated, were never compared aftec they wese received from tha Drinter, and iu one or two instances, ut the re- Sueut of members, papers were sent direct from fhe printinz-ofice to their houses, so that fhey might receive them early in the day. THE POINT sought to be develoned by the examination of Me- Kinney iy that Ct ate No. 1, wiica Levisses jdentified as containinz his gennine signature. €on- afis only the single statement tust the Electors e for President ona Vice-Presidents whils Cortiticate No. 3, to which Lovissee fays his s Tature is a forsers, contains ‘the double staten o he voto for Prosident and of the vote for ¥ Presidert. 1t apoe volnmes—ihe onc in qui with the Congressional octavo form -it_is only tuis curions fact the on be offered by Mr. Mchiune, Electoral Commis<ion, was Lo of Nos. 1aad3 wer Hrst pace that in gathering toze were not used they GOT MIXED UP TOGETHEY, there being no printed numberto ¢cisting and, wheu he handed to Mumhy, the of ographer. the copies to ba printed in the h them, sten™ ppeudiz, he had given hiw tvo of the samo kind ustesd of two of diiferent kinds. ‘Phat was the substance of McKinney's testimony, excent Lhat nother somewhat 1terestiug incident tat was, tuat some £y 0F 3 upon bim and aifference n Mz Mciinney did not ut e Lic and Garteld went to ¢ printed volum camne frosh upon certificates Nos. 1 and Hrst recollect it, bat, comparing the cets! the recollection of the diZer 4e T nd he wtated it to Gartield und furnished uid 1 Separate covies.
