A Patent Ownor Wants 300,000 Damages from the Pull- mans, New Sults, Divorees, Judgments, Confessions, Ete. OBADIAII JACKSON. gua TITLE TO THE OLD UURNETT HOUSE PHOPEUTY. Judee Drummond wad occupled all day yes- terday In hearlug & complicated Chancery sult growing out of the dificaltics ofsObadiah Jack- pun, and Involving §100,0001n money and thetitle to n valuable plece of property just south of the new Custom-Tlouse. Tho facts, Lriefly stated, are as follows: On the 1st day of October, A, 1. 1863, Charles . Waite, of New York, was thio awner of Lots 15and 16, In Block 111, In the School-Section Addition to Chicigo, and on that day madea warranty-teed of safil yremises to UGeorge N, Wiliams, of whom the sall Walte knew nothing, the entire transaction having heen conducted for Waite Ly Oba- dlab dackson, of Chleago. Walto recelved for the property from Jackson $10,000 fn cash, and two notes purporting to have been ade by sald Williams, one for 30,000 and the other for 330,000, both of which notes were stated 1o have heen secured by an alleged deed of trust of sald premises, dnted Oct. 1, 1583, Tavine the nnme of sufd Wililama as grantor, wherein Jackson was utemeil as Trustee, and the mote for 830,000 was payable Oct. 1, 1872 ,“'llllln n few days after recelving the notes, C. . Waite suld and transferred them to his trothier, 8. M. Waite, of Brattlcboro, Vi, Af- terwards the note for $30,000, Indorsed fu blank by 8. M. Walte, was placed with Jackson for collectlon, Oct, 5, T3 (four days after the transfer from C. C. Walte to Willlams), the premnges were conveyed to Mary I Moud) v of &nahvme Tenn,, ‘ny n warranty deed srom Willlams, " Apell 18, '1871, “Jackson borrowed 841,600 of Duvtt Smith (now dead), upon his note for that sum, pay- able twoyears after the date thereof, and, n collaternl” thereto, pledpred the salil Williams! note for 830,000, and the enid deed of trust from Witllams to Jackson. When Juckson so pledged the sald Whlinms note, he put severnl andorsements of Interest thereon, ‘The lust of ealil fudorsements was dated May 17, 1871, and all of them are slgned: 8, M. Waite, by O. Jackann.” May 17,1871, sald Moody, by her war- mnty deed, (-uuw.-yt-d tho sald” premises to Chatles V. Dyer, of Chicago. By a deed dnted Oct. 4, 1871, and ncknowicdped Aug, 8, 157 Juckson released to Dyer tie sald truat<deed from Willlams to Jackson, Juno 1, 1872, Dyer, by his warranty deed, recting tho asid fncun- Drance of &30,000, conveyed the premises to oy o tho B0 day of Avicust 197, of Edwin aud Joseph Bwift, defendants, of Ulilladelphls, the sum of 50,000, and to stcure the pay- anent thereof, made hila deed of trust of said reises o Norman C. Perkine, For David with, when living, nnd for the complalnant, sdminlstratrix sinco his denth, George and John Wataon,of Chicago, had, and have had, exclusive ¢harge of the transaction whurein the Williams note of $30,000 was pledeed _% Jackson. This note matured Oct. 1, 1572, e Watsons held 1t from ‘April 18, 1471, until November, 1870, without collecting, or attempting to colleet, rither the prinespal or interost of sald note, and sbout the lnst named date, the complaiuan led her bill praylug that sald notebe declared a fen upon nuldd)rumllcs, aivl a prior lien to the Incumbrance thervon of $50,000, under which he 8wifta clnln, upon the theory that there- eso from Jackeon to Dycr wus fraudulent, clalming that, although dated Oct, 2, 1871, it * was not made until Aug. 3, 1872 (the day of the Bwift Joan), ood that the Swifts orc charged with notico of the Williams lucumbrance, by the recital thereof in the deed from Dyer to Fackson. The caso was argued, at great Iength, by Judgoe Hleeins and Mr, Burgess for_the com- r‘ahmnl, and by Mr, Goudy and Mr., 8kinner for ne defendants, who reslst the complalnant’s temand by clathming that Willisms was a myth, and on alins of Jacksou, reasoning therefrom Wiat the deed from Witllumns to Juckson, under ‘which tho complainunt clulms, is simply a deed from Juckson to Jackson, and therefors vold for wunt of partics, and, cunsequently, did not con- wey the land. The defendnuts’ coungel also tirged that, conceding the Willinme nots to he genulne (which, however, they clalmed to be spurious), the complamant hai no title to it, as It was placed with Jackson by B M. Widto for collection only, with notico of which fact the votmplainant ls charged, by reason of Jacksou having Indursed payments of interest on the note, and signed them 8. M, Walte, by O, Jucksow.” “Thu defendants’ counsel further srgued that the complaiant sas pullty of such Jaches In holding the Williams note for four years alter moturity without any attempt to callect either principal or interest a3 would preclude her from recovering. The pusition of tho defendants, fn assuming ‘Williams to bo a myth, led the plaiotifl’s coun- sclto urge that, i e’ was o myth, tho decds Trom Walte to Willlmine, and from Williams to Mooay, were also vold, which would deteat the title clalmed by the defendants, Swifts, under the Perking deed, To this urgument Mr, 8kine mer replied ns follows: ‘‘Buth sldea claim titlo from o common source, C.
