THE COURT-HOUSE. exton’s Claim for His Imaginar. es Extras Talked Over. a Walker Wants to Be Paid Extra for His Thick Stone. ‘The Joint Committee on Public Buildings and. Pablic Service of the County Board held a meeting yesterday morning to consider several ‘connected with the new Court-House. Thee were present Commissioners Schmidt, who presided, Hoffman, Guenther, Mulloy, Carroll, Cleary, and Fitzgerald; and Conly: fexton, Walker, and several others. Commissioner Fitzgerald called for the read- ing of the contract with Sexton. ‘The Clerk read it.. The contract contains this clause: “And it is further agreed on the part of the said first party (Sexton) that he will not pold said second party (the county) responsible, por claim sny damages fur any delay that may pe oceasioned by other contractors during the 5 of said Work or erection of said build- : Commissioner Fitzgerald moved that the gommunication be placed on file. ‘Mir Sexton sald “other coutractors” were aordelaying him. It was the county. Commissioner sonsty had not delayed Sexton. Commissioner Gventher asked Sexton in what war the county had delayed him, ‘Mir. Sexton replied by not making the contract. for granite in due time. Be said he was under a forfeit of $100a day to complete the work within a given time. He had maae preparations toget through within that time. The county had put obstructions in his way so that he could not do it, and he claimed damages. SEXTON URGED that bis claim did not conflict with the clause of the contract relating to delays on account of other contractors. He read the points in his communication: “By reason of delay in getting the granite work atthe three raain entrances. and in the corndors.” At the rime his contract was made there was no thought, of granite, and helad no riebt to expect any delay by reason ofthat granite work, because there was none there. 4 part of the stone tbat was intended to beat those points (main entrances and corridors) was already set in place. Commissioner Schmidt—Would the wall hare to be taken down again? Superintendent Handley—It can be built £0 that it will not have to be taken down. Commissioner Fitzgerald was opposed to guchwork, The wall would have to be taken own. Superintendent. Handley said the worst crouble was that the mev who had the contract for putting in the iron work could not put the vans in without double expense. The walls sould have to be cut in all the upper stories. ifthe work was commenced right there would ‘de no patching. Commissioner Guenther said it would not be necessury to build any part of the dome except where it commences. ‘ Commissioner Hoffman remarked that if this work was done without the consent of the architect, his bondsmen could not be held re- sponsible. ‘After a dispnte as to the cost of the wark pro- posed in the resolution, Commissioner Fitzger- aid moved to pustpone action for one week, sayingthat he wanted the work competed for. ‘The motion was agreed to. THICK AND THIN. > The communication of William MeNeil & Son, in which they claim the difference in price detween the thick and thin stones used in the Court-House, was then taken up. In connection therewith were read the com- munications of Architect Egnn, setting forth that the contract, planus, and specifications would be found sufficient to protect the coun- ty’s interest in this particular, and that any at- tgmpt to “corner? the county in this manner Would be met with signal death, both thick and thin stone beiug provided for; and remind- ing the Board that he (Egan) was sole arbitrator Jn such matters; aud that, as Walker had de- clined to give an estimate of the increased cost, {twas impossible for him to Iay before the Board au estimate of the amount. Commissioner Fitzccrald said if it were trac, as Eran stated, that the county got a. better building by using thick stone, be felt as though McNeil Son ought to have’ some compensa- tion, In order to settle the matter he moved that the communication be referred to Egan With instructions to send in an estimate of the extras on the two stories.
