GEOROH 8, RIMDERLY, The Court, reconvened at 1:30, Mr. Beardaley on the stand! Mr. Ashton told him that he had paid his bill to Periolat, and supposed the whole matter had been settled. Mr. Beardsley was then temporarily with: drawn, and George 8, Kimberly was sworn: He was Warden: of tho Insane Asylum in July, 1874, and was so appointed by the Cotinty Commissioners, Messrs. Ashton, Russell, Johnson, Jones, Carroll, aud Harrls were membera of the Board. During 1874 the Insane Asylum and Poor-House were furnished with oceries by Forsythe & Co, and with meat by fl‘u h M, Sweetzer. 1L was bis duty Lo recelve and certify to all goods, and during 1874 he cer- tifled to recelving goods every month which were not recelved. 'The witness then explained the system of getting orders for supplica through the Board every month; the sendlng in of arcqulsition to the Board: ltareference to the Committee on Pabllc Charltics; and Its finalal- lowance by the Board, When the goods were reveived, a bill would accompany them which he would approve and return to tlie County Board for payment, ‘Fhe biils usuatly called for from several hundred to $1,000 worth of gooits more thay wera actually received, and durlng the car the shortage ‘of goods amounted 1o not eas than m.oofi He sometimes certified to the bills in Foraythe's store, il then again at the Asylum, where he lived. Letiolat would say to hit, at thues when he onght to have paid him money, that he could not pay him anything for the reason’fhat lie had to pay”bille to Forsythe apalust the Commisslonera. Hera Mr, Tuley tried to prove what Perfolat hind tolg! witness as to whom he had paid money to, but the Court ruled It out as incompetent, Tho witness continued: The meat bills were nlso ghort, the ahunuévu amounting to us much n8 $100 per month, Commiseloners Harrds aud Jolinson knew of this fraud, and had spoken to Nim about it in July, 1874, The conversation was excluded h{ ,tho Court K”‘“‘““ the witness could not positively fix tho ate. "The contract price for ment was five cants per pound, and the quantity sent to the Asylum a8 per bill was greater aftor July 1 than before, The witnoss wus liore shown some of the ocery billg of the Commissioncrs from which fi;a printed head had been torn off, Ile recog- nized the bills, and they had been given him by {’;““}m“' Ilo received the bills in"the fall of N Mr, ’l‘ule{ here trled to prove that Periolat Tind told Kimberly that the bills In question had been pald by him,; and must be deducted from tho fraud fund between witncss and Perlotat cte., but the Court sustained an_objection, and hohl the guestion incompetent under the fore- noon ruling. MR, TOLDEN had been present when goods wero recelved ot the Asylum. At onoe timo the Cominitteo on Public Charities recelved the goods, and lie once refused to certify to a cortaln bill in which thero was 4 shortuge Of goods; Mr. Holden kuew of the shortage. The shortages generally conslsted of tho absence of packazes, nnd also in short welght, Witness certificd to bills when he knew the goods had not been delivered, and never atopped to ask any questions, Periolat had pald him money at ihe store of Forsythe & Co, Perlolat “offercd him a check for 85000 at ono time which ho refused to recelya; Perlolat got the check cashed afterward and gave him the money. To had often mot Ashton, Halden, Crawford, Joncs, Russcll, and Harris at Perlolar's offier, *Heeaw Jones there ubout tho tmo of the Infe investi- gatfon, but nothing wus sald in_his hearing in relation to money. Holden, McCaflrey, Hor- ting, and Juhnson received the zoods upon one occaalon when there was a shortage of about 8200 wortl of goods. The witness thew, in_au- swer _to the question of a juror, explained at lengzth liow tho shortages occurred, saying that when four burrela ol slrup were ordered only two would be furnished, cte,, While four were pald for, and fn many instances that the welght of packnzes was {ncreased on the bills about onc-third. He remembered the Holden Investigation in reforence to the shortage In dry groods in 1876, and a visitation of the Commistfoners. The in- vestigation was subscanuently dropped, that {s, after u meeting of Perlolat, McCaftrey and him- sclf ut Forsytlie's store. Mr, Tuley endeavored® to prove that at the meeting McCaffrey was given €500, and the in- vestigation was stopped on account of It, but the evidenco was excluded as incompetent, Witness continucd, stating thut Perlolnt told Tim that the frm of 'l-‘ursjlhe & Co, owed him sKlmhcr)‘y? a balance, and wanted him to trans- er it to Iifin, so lie could thu money and use it, promising to pay it back. He told Forsythe ho nioney to Perfolat, it befug a-part of o " account. At this point certain MEAT AND GROCERY DILLS for 1875 were called for, but could not be found, whereupon John Cumisky was sworn as to whether be had produced all such bills in his noseesslon, He sald lio had, and that tha bills had been in the posecssion of tho Grand Jury, oud he did not think that all he guve the jury bad been returned to W, Kimberly continued : "Thegrocery bill for Feb- ruary, 1870, had been shown him by the Grand Jury,—the hill he had not certlfied to.
