Decision on & Question of Bank= rupt Lave, Record of Judgments and New Suita--- Criminal Business, Judge Drummond yestorday decided the pati- tlon of review of Lewls Levin from an order of the District Court. Levin filed his petition for discharge Feb, 10, 1876, and the 25th of March following was sct for the hearing on the application, No ohjection hieing made, the mate tor was referted to the Register for final report, and on the same day the bankrupt mado his finnl onth before the Register na provided by the statnte. Onthe8dof April Willlam A, Hul- bard, who had previoualy proved up his clain agafnst tho estate, entered Nfs mppearancs fn opposition to the dischorge which, Levin moved to havo stricken from the files threc doya nfter. The same day Hubbard asked for leave to file his objectlons to the dis- chnrge, which was opposed by the bankrupt on the ground that the nppearunce and cficas tions were not filed In time under the provis- fons of Rule 34 fn bankruptcy. This mile re- quired that any creditor opposing thy l“u‘lmflil: of a bLankrupt should enter Nis appearance fn opposition on the day when the ereditors were required to show causd*'why the dischargeshould not be granted, aud should flle hin specliications of his ground of objection within ten days thereafter, unless the time should be extended by the District Court. The District Court over- ruled the objection of tha bankrupt, and al- lowed Hubbard to flle his specifications, from which Lewis filed n petition for review, Judge Drummond, after reciting the facts, snid the question was as to the correct- ne:s of the Judge's ruling in siowing the specifications to Ge filed. It appeared that more than ton dnys hullpn!ml from the 25th of Murch to April 6, when Hubbard asked leave to file speciications, and that he hud not fled them, #nd his_ appearance had not been entercd on the day {t ought. The bankrupt had clafsned that therule was abeotute inits terine, and that If ten days had clapsed between the thie of fillng the appearance and specifications, or be- fora applieatiun had been made for an extension of thine, the power of the District Court to exer- clse tha discretion of allowing them to be filed ceased. Judge Drummond, however, held that the District Court had power to extend the thne after, o8 well o8 within, the ten days, In equity, when n discretion wos given, it had uni- formfy cxerclsed after as before the time desig- nated, and there was no reason why such rule should not be followeil fu the present case. The order of thuy District Court was thercfore aflirmed. DIVORCES. Alila A, Giles filed a bill azalnat her husband, Jnmes 'T.
