A BOANTY RECORD. ‘The amount of negotiatidn in progress in the real estate market has been large and spirited during the paat week, in spite of the very de- Ppressing weather which has made it almost im- possible to show property to inquirers. The results, however, nave not been apparent in as large a number of important sales as we had to rocord last week. In a number of cases whers cash offers have been made both parties, if there i any difference, are very temacious of their figures. In such cases the property is generally offered at eomothing like sacrifice, and #ho seller is not willing to go lower, whilo the buyer expects fre- quently a better bargain than he is fairly on- titled to. Acase or this kind is within our Imowledgo where a differencs of $3,000 prevents nsaloof spiece of real estate that sold for $108,000 before the firoof 1871. The holder wants only $65,000; he is offersd baut $62,000; and there the matter stands. The Aact is, the present prices of real estate in Chicago are felt by owners to be at the ‘‘bardpan ™ point, and they are not ready fo make farther concessions. Thia gives the mar- ket a great deal of steadiness. The movement in suburbau property has not yet faizrly opened. The alluring charms of this species of realty can best be made apparent in balmy dags, which bave not yet beon experienced. The lst of Msy baving passed, & large demand for residerce property that was folt prior to that date has been satisfied or diveried into lessed property, and & natural panse iu business has followed. CAPTTALISTS PARTICULAR ABOUT AEGURITY. There hos been a fair amount of activity {hs Ppast week; in fact almost il the agenciss, from the least o the greatest, hava had something to do. Loans for improvement of property are in the majority, but they are not 80 marked a fea- ture as in the previous weeks. There is plenty of money for investment. Capitalists have not lost faith in Chicago real estate, but ‘their re- qurements 33 to securities are rather oxacting. Inside business property flods no dificulty in se- curing loans a$ 8 or 9 per eent, but outside, fancy, and speculative enterprises sre looked upon with much suspicion, and no one seems willing to ventuze their money on this kind of security. . There is at last a prospect that the long-talked- of and much-deferred drive alonz the Lake shore on the North Side, betwesn the Water- Works and Lincoln Park, will be eompleted. The Lincoln Park Commussioners at their last meeting appropristed the money necassary for the work, including -» separate road for fast driviog, and the contracts will probably be let during the preseot week. The . Com- missioners are understood to have on band nmearly all the _ funds thoy will need for this enterprise. Property-owners on the line of this boulevard have been so often disappoiated in their expectations of seeing it actoally built that some of them have grown incredulous sboutit; but this action of the Park Commissioners seems to give aasurance that the work will soon be under way. Root lectured before the Union College of Law oa **Abstracts of Title.” His remarks were substaniially as followa: One of the moet, if not the most, importang branches of the law is that which relates to the ground upon which we live. Originally, naked possesaion was the only evidance a man had of an interest in or ownership of Iand. His teoure depended upon his physical ability to hold the possession. In progress of time, how- ever, the right of ownership in particnlar parcels of 1and began to be acquiesced in, be- cause & covetous man, having power to drive some weak noighbor off, mighs find, apon his re- fum from somo marauding expedition, that some stronger than he had occapied; so thatit was rather fear than any particulac sense of right ar of honesty that induced the erystallization pro- cess whereby the rights to 1and were defined and acquired the force of law. The next step was to rocoguize tho right of property, although not coupléd with possession, for in the earlier times men were much called away from their homes by war, and therefore some additional evidence of ownership became necesaary to secure the rights which otherwise the first squatter might violate. A SYSTEM OF CONVEYANGING grow up whereby writtea instruments wers used as evidence of title. They were called muni- ments of title, and passed with the land to the purchaser. What we callan * abstract of title™ is a synopeis of the several instruments and pro- ceedings composing & chain of title prepared by some person familiar with the records. Bafore the Recording act in England, all deeds passed with the possession, and it was the busi- nees of the conveyancer caployed to arrangethe business to examine all the conve; aad to make an abstract showing the title. It was a specialty, and some of the old and well - estabiished conveyaacers retained the - custody of these muniments, so that every tims tha property changed hands they seemed to havo s corner on the business. But in those dsys ths tendency was to keep estates together. 1In this country, however, where the statates of nearly overy State, if not ofall, provide for re- ecrding of conveyances, and the uso of certified copics thereof in evidence, peoplo bave bocoms exceedingly careless, and original deeds and tax- receipts have not uniformly been preserved. The advent of s great fire, which de- stroyed tho entire records of a county with & popnlaiion of half a million, snd whsre for thirty years the haodling of real estats haa been carried on 83 & distinct business, lndvr.‘ézu almost every citizen has made from cze to fiity deeds, has demonstrated that EVERY SCRAP OF PAPZE which relates to a title, or which throwa light upon it, should be sacredly preser Even if the record were not destroyed, it may be incorrect.
