Tho examirations of the ballots in the con- tested-clection case of Ward vs. Harri Tesumed at 10 o'clock yesterday morning, and continued unlil 5 in the evening, atwhich time the msfority of Mr. Harrison had ben increased to, somewhere in the vicinity of 150. The pre- cincts counted were: the First, Second, Third, and Fourth of the Twelfth Ward, and the First, Second, and Third of the Thirteenth Ward. There ara yet twelve precincts to be.counted, ‘which work will probably be accomplished to- day, as the different parties in this case are very Gilligent, and get through their work in a busi- ness-lika manner, THE. Life Insurance Policies and Insanity. Judgments and New Suits. ‘THE SCAMMON-MARINE BANK CASE. The motion for a secoiver in. the recently filed bill of Dow and others against J. Y. Scam- mon, the Marine Bank, and others, came up be- tore Judge Farwell yesterday. The parties were not ready, and 28 they could not agree on a time to ‘which to postpone the argument, Mr. Le Moyne, attorney for the complainants, asked the Court to appoint an early day to hear the argu- méot of the motion, Mr. Ayer, on bebalf of Air, Scammon, said that he wished the argument postponed until Air. Scammon could, angwer the bill. There was great doubt whether such bill could be filed by a minority of the stockholacrs. against a majority to wind up the bank, and a5 the affairs of Sir. Scammén wore thoroughly re- viewed io the bill bo should havo ample time to read it and prepare his defense. Mr. Scammon then -aaid that the bill went into a bistory of tha bank ever since his con- nection.“ with it, and he should want,at least ton days to prepare his defense. | He also wantod to get the deposition of Mr. Rogers, who had been with the bank for many years, and was as yespectable a man as there was on the footstool. ‘Judge Farwell said he was inclined to give tho time, asked as be did not sce that there would be any ‘great distress or rivk. There was no necossity to heat itat once. It was a case where the parties should have a chance to be heard, aod where the motto should be to hasten slowlr, ‘as it involved large business transactions. ‘fhe ‘ooks could not be altered in tho meautime, nor tho papers be disposed of. ‘Mr. Le Moyne.said he wished to be heard be- foro,the Court decided the question. He said the present case was not an application for the appoiatment ‘of a Receiver for Mr. Scamnion, Lut for the Marine Company, and, by an aftida- yit of Mr. Bogue already filed, it could be seen that the corporation made no resistancé. - ‘The affidavit referred to was to the effect that » meeting of the Board of Directors, had been peld, the day before tho bill was filed, and with notice that it would be filed, ‘at which meeting it was voted .to make no defense to the bill. Mr. LeMoyne proceeded to remark that ir. Scammon had pretended to be the bank, and had persisted in holding on to the shell after the contents were. oxbausted. He had also squan- dered the mouey of the bank, an ppearod by tho afidavit of Coddington Billings, had taken a number of: the bank's notes, canceled them, and delivered them up to the parties who made them. The affidavit referred to alleges that Scammon’ lately took four notes for $400 ‘each, one mide by John Forsyth, aiother by one Evarts, aud a third by Roge:s, and surrendered them to the makers, charging the amount to the “old organization account.” Counsel urged that it was necessary to have an early day appointed to hear the mution ; tat it would not, interfere with Mr, Scammon personally, and tat he could have plenty of time im which to an- awer the bill individually. eo” Judge Farwell, however, declined to pust: matters, and postponod the argument on the ap- pointment of & Becoiver until a week trom Mone day. : SANE OB INSANE.
