Tho loan was socured by & mort- gogo on real estato iu the City of Chicago, and necompaniod by n power of atiornoy authorizing the Mortgago Company to enter up Judgmont for tho wholo lonn atorieo in raso of dofaultin prying auy installment aa provided by the tdrme of the loan, Mr. Scommon laving failed to pay “the Intorest dua Novombor 80, 1874, tho Mortgage Compouy declared tho l‘prhmlpul sum duo at once, and on March 31 ndvertined tha mortgaged proporty for salo. This motion was resisted by Messrs, Trum- bull & Ayer, on the ground that tho mortgaged proporty had been bid off by tho Tresident of the United States Mo\‘tfingo ‘Company, at a groat sacrifice ; that it would be inequitable to allow a Lud;:mnnl, to bo ontered up for tho nlance of the principal not yob due; that, by the salo of the mortgnged premiacs, tho Unifcd’ Btates Mortgnge Company had mado and received more thau the full amount of tho Interest due ; nnd that, no installment of intorest or principal being now duc by tho torms of tho lonn, no judgment could bo entored up on tho warrant of attorney. In other words, that it wos compotent for Mr, Scammon, at any time before the entry of a judgment under tho power of attorney, to have come forward and baye paid all installmants then duo, and bavoe thereby pro- vented the entry of judgment forthe installments wlich, by tho torms of the loan, wera not to fall ‘duo till o fubure poriod; that by tho Balo of the mortgaged premises the United Stntes Mortgago Company bad paid itself all that was duo, and that it ‘must wait till thero wasa failuro to meet somo subsequont inatallmont bofore it could declare the whole sum duo and enter jndg- ment for the amount undor tho power of attor- ney. Tho lendors omployed Mr. McCngg to draw the papors, and, it is to bo umed, followed his advice in ro- gard to the ure, and hero they wero, Asto tho oppression, it is casy to make sweeping cliarges. ‘* THE EVIDENGE just taken before Your Honor,” gaid Mr, Dextor, **yhows that the dofault ocourred last November, and that thie Mortgage Compeny did not prosg Mr, Bcammon, but waited all whiter, and during tho wintor repoatedly offered to mako him a now loan for the intoreat due, which Mr, 8. declined.
