The Tax Appeals Continue---Judgments==- New Suits, THOE EENNEDY CASE. The endlees Ellen Kennedy case was up before Judge Williams again yesterday afternoon. Miss Cuarlotte Biske was thd person examined. Mr. Asay moved to quash tho writ of habeas corpus, Put the Judge thought it was entirely too late, 25 ¢he had fled on answer, and tho writ being rather a common law procecding, the motion, beiug in tho nature of a demurrer, should have been presented beforo the anawer was filed. Miss Blake then took thestand, and testified {hat she was employed in the Orpban Asylum last June, and know Ellen Kennedy. She was {n wit- ness’ company tho night she dissppeared. They wont to the Michigan Avenue Baptist Church sud returned about 9o’clock. Some one told the ¢hildren who wero with her to go to bed. Sho iad several children with her that evening, but could not tell the number. Some one else told the children to go to bed. Bhe basnever minco Jeard of Ellen nor her wheresbouts. She did pot make any inquiries about where sho had gone. On the Sunday Ellen disappeared wit- pees eaw & paper which stated that s guardian 1ind been appointed, and advised with the Presi- dent, who decided that she must be given up. Ellen saw the paper, and asked witncss if she was to be given up. Witness eaid she was. Ellen then objected strongly to going away, and Pecams excited. - Witness thereforo concluded that Ellen had run away, and thought that Ellen was now in the posscesion of tho Catholics. Miss Myers and AMiss Bennett were both in charge of the asylum that evening. Considerable more evidence was produced, but nothing eatisfactory was elicited that tended to Frove that the witness know of the dieappear- snce of the child. r. Moran then asked leaye to produce an in- mate of the asylum, a_girl who slopt with Ellen, beforo the rulo be discharged. ~Alr. Asay object- ed, oud asked that the rule be dismissed, 28 tho evidence had producod votning, aod it was un- }usl that tho officers of the asylum slould be onger barassed. Judge Willinms esid that he thought the offi- cors of tho institution had testified fairly. and that those who had been examined had wothivg todo with the child's disappearance. They evi: dontly had agreed to give Ler up whon tho guar- dian was appointed. 1t waa poseible that further evidencs might show whera the child was, and %is disposition wos to be as easy as' possi- tlo. He therefore fixed Monday afternoon as {he time when tho remmning witness should be examined, and, if no further light was thrown on the somewhat' mysterions disappear- ance of the child, lie should a¢ that time dis- charge tho rule finally. ° 1t Is now abont ninc months since Ellen Ken- pedy disappeared from the Orpbau Asylum, and not the least trace of ber has as yet béen found. Nearly all the_ officers of that institution have been examined, yot nono of them kuotw anything spparently of hier whereabouts. BHIl another chapter of.-the ys that are dark,” in connection with the National Life ln- furatice Company and Benjomin Lombard, was detailed yesterdsy by the bill filed in the Circuir Court by Rirck Hawes, Receiver of that Company, against William H. Shaw, Henry B. Bhaw, and J. A. Griswold. Hawes sets out that as Receivor it is his duty and pleasure to collect 21 the ssets that may belong to the Company. 7. A, Griswold, he staics, is_the owner of 160 shares of stock in the sbove mentioned ill- starred Company, When this stock was taken, £ note was given back for about $8,000 in part payment, and 9¢ shares of tho stock assigned 1s colfatéral security. Denjamin - Lombard was the President, and it is owing to his fnancial manazement that the Company is in its present tondition. Benjamin being a little short at ono time, and_desiring to secure a certain indebted- ness to William H. and Henry B. Shaw, ‘“bor- towed” tho stock and note abovo meutioned, \nd, baving indorsed the Company’s name, as- sigued it for bis individual debt. The Receiver fiarges that the Bhaws bad notice of this pro- teeding and the fact that the Company borrowed the notes, aud, therefore, aro not bona fido hoid~ »rs. He hns askod them to refund, but they have refused, and the present suit is to compel such a raconveyance to the Company for the ben- it of its numerous creditors. ~_An injunction was alto aeked, and granted by Judge Williams, to prevent the defendants from disposing of the notes and etock to any bons fdo holder. TROULLE BETWEEN LIVCRY-STABLE MEXN, Patrick J. McNamara tiled 2 bill in the Circuit Court againet his partner, Oven Evans, for s distolution of pactnership. _Complainant states that in December last one Hammond and said Evans were in_partnership in the livery busi- pees at 58 und G0 Sherman street, At that time McNamara bought out Iammond's interest of ap undivided one-balf and went into pariner- sbhip. Ho Lias_given his whole time and atten- tion to the business, but charges that Evans has groesly meglected his daty, failed to return faoney coliccted, o to make proper entries on the books, aud threatencd to collect all there is due the firm and broak up its business. _Dc- Namara, therefore, desires 2n injunction and dis- polution.
