Dester Gives Kotico That a Change of Yenae 1ill Be Asked on the Gther-Indictment. The motion to- quash the sacond indiotment sgainst David A. Gage for pérjury was argued yesterday. befors Judge Moore, in the Criminal Conrt. With tho exception of twenty or thirty members of - tho legal fraternity, there were very few persons present, and littlo interest was manifested. Tho proceedings began at 10 g'clock. He clzimed that the indictment should be quashed on tho ground that it had already, in fact, been quashed by Judge Rogers. The subject-matter. s the same, and no Dew facts were allegod. He then read. extracts from the decision of Judge Bogere, showing that this indictment’ wea lisble to be quashed for the samo, ressons that the first ono was quashed. fr. Reed hero interrupted Mr. Bwott to say {bat the first indictment stated that ho was ro- quired by tho Iaw to make oath to the account on the Gth of December, but not that he was re- qured by lsw to rander the account on that day. fha new indictment set forth that both the oath 10d tho acoount wero required on that day.
