It will be remembered that, aiter the Clerk had apnouuced tho vote, which was 2) for snd 17 agmnst coufirmation, Ald. Bailey jumped up and said, **I change my vote to yes," and that the Mayor thereupon de- clared the appointment ratined by the Conncil. This was considered unwarzantable, os 1¢ has always been tho custom in the Council for the Clerk to snnounce the result of o vote. and not to permit on Alderman Lo cbange after it has been aunounced. The Corporation Counsel was of opinion that, in all -deliberative bodtes, the clerk is a mere machine, without any authority ofauy kind, and that it is the auty and proviuce of the presiding officer alone, to enuounce tlo_result of a Dallot; that tho announcement wade by the Clerk of the vote on the motion to confirm the appointment of Mr. Hamilton, was not iu accordunce with parlimentary law, and therefore, the addition of one to the yeas, pre- vious to the Mayor's aunoupcemont of the vote was perfecily proper, settliog the question of" confirmation, and _entiling Mr. Hamilton to legally hold the office.
