Judgo Williams was engagod yostorday morn- ing in hearlug an argument to dissolvo tho in- junction granted in about twenty-fivo casca of tax-appeals from the judgmentof tho County Cour, involving about $00,000. Tho cases are all similar, reciting tho rondition of tho judg- mont by the county, the pondency of & potition for mondamus in tho Su- promo Court, snd tho fear that the County Collector will eoll unloss an injunc- tion is framed to restrain him, and injunctions wero readily granted by & Master in Chancery without any notico to the city. Answers wore filod by Mr. Tuley for tho city, and the case camg up on a motion to dissolve the injunction. The counsel for complainants allego that the Constitution of tho State guarantood an appeal from sll lower courts to tha Supreme Court of the Btate. That tho provision of Bec. 10 of the Jaw of Lho 28th of March, 1873, on which judg- mont was obtained, was unconstitutional and vold, because it roquired a property-holder to doposit with tho County Calloctor the amount of tho taxes befors tho appeal could bo allowed. Tho record showed that tho County Judge ap- proved tho bonds which wore filed, which was in the ordinary form, The Court declined to liear anything from tho city in reply, and sald ho would admit that the Constitution guarantoed an appoal, but ho know of no particular way in which it was guaran- teed. Tho Constitution was silont as to the mode, that whilo .the practice had beon to allow an appeal on fling o bond in double the smount of the judgment, no authority had been pro- dnced and noue could bo found. Tho Legista- ture could proscribo the torms, and in this oase they had imposed the condition of dopositing tho moncy, and he saw no reason why sucha law could not bo mado under the Constitniion. Tho decision of the Supreme Court, which was clted, in the caso growing out of the same judg- mont where they rofusoed to allow a suporsedens, was, o thought, an intimation of the Courf that the limitatiousin tho Iaw as ton supersodeas boing allowed would be also applicablo as to an appeal being granted. Tho injunction was die- golved. Complainants thon moved for an appeal from the decisicn of tho Court on tho ground that it wne o final order, and as suoh could be ap- pealod from. Tho Court, however, held that tho uniform practice had boen torofure an® appoal from an intorlocuory ordor dissolving an injunction; that it was nob n fnal order, and the appeal must be refused. Counsel for com- plainant alleged that be wia taken by surprise, and wished until this morning to determine what courge he should take, whother toobtain leave to dismiss the bill without prejudice, or allow a decroe against them. ‘Tho case was, therofore, oontinued until this morning.
