Small, the trinl proceeded with: tho oxamination of tho witnosses for tho prosocu- tion. Tho testimony was short aud to the point, being the same as that given at thoinquost, and on the adjournment for that day only two wit- nesses for tho prosecution remained to bo heard. “Thoso were hoard tho day following, Sept. 10, and five witnossos woro called to prove the gomf character of the prisoner, after which an. equal numbor of robutting witnosses were cl\lle:} to show his bad character. Tho Btate's Attorney then waived the opening speech, and Mr, Small msde an argumont for mitiga- tion .of moutenco, in caso tho prisonor was found guilty.
