Tho liquor tost-caso under tho new law, por- mitting s woman to suo for damages tha enloon- Xoeper and ownor of the houso whero the saloon was kopt, was concluded yesterday in the Cironit Court. Tho plaintiffs claimod that Lieyors, the husband of tho plantiff, wont to Mack's saloon, aud thero bocame drunk, aud whilo in such a condition he booame engaged in & quarrel, and was killed. The points to be proved to onablo plalntiff to recovor wore the Intoxication ; thatit was at defendant’s ealoon 3 that such liquor was given as would intoxicate; that defondant knowingly sold or gave away such boverages; and that it was a natural, though not necessnry con- goquence of such intoxication, that the quarrel and death should eosuo. Tho defenso do nol dony that the law was Constitutional, but think that the law was not applioablo undor the presunt clroumstances, They hold that Aeyers came to Mack's placo to buy the snloun, and was nob drunk when tho quarrel took placo. The trial was closely contested, and much contradiction manifest in tho testumony of the witnesses, and, in their judfimont concerning the drunkeness o the deceased. The Judge, nmong other things, charged thet tho jury were outitled to award oxemplary dam- ages of smart-monoy ; that it wasa civ suit, and tho plaintift need not prove tho notual dam= ago sustainod if she proved that her means of support was diminishod by roason of her hus- baud's death, If tho death was not likely to oc- cur, but did_sotually occur, it was sufficient to fix tho liability, A dofinition was alao given of jntoxicntion. The dofense claimed thac the de- fondant must havo actus! knowledge of the sell- ing liquor to the doceased. “I'ho jury were locked up at about half-past 6. The Judge remarked, after the jury wont out, that, if thoy did not agreo by 10 o'clock, ho would dischargo thom, as they cortainly could agroo in fivo hours, At half-past 0 tho Judge, counsel for plaintift, and a ''RIDUNE reporter went into the jury-room.
