o CREDIT MOBILIER, The Great Law-Suit at Hart- ford. Answers of Defendants to the Bill of Complaint Filed by the United States. Observations of Thomas A, Scott, Corne- Iius Bushnell, Androw Carncgle, Charles 1. Neilson, and Others, Spectal Correspondence of The Chicago Tribune. Haurron, Coun,, Sopt, 19, 1673, There ia nothing which is likoly to oxclte mo gonoral attention fn tho country at largo am the proceedings of tho Govornment against the stu- pendous frauds which hnye been porpetrated under cover of that mysiic organization, tho Credit Mobilior of Amorica. Tho case iy of in- tercst ou account of tho vast amount of money involved, the quostions of law, and the numbor and distinction of men, both as dofondants and couneol, The ITon, Ward ITunt, of Utiea, N, Y., Judge of tho United States Supremo Conrt, and tho Hon, Nathaniol Bhipman, of this city} Judge of tho District Court, will constitutd the Court for the trinl. Thoro is alvoady & porceptible stir in tho mattor, Judgo Shipman has arranged Lis office with moro than usunl earo; an ocensional lottor comes for Judge Iunt, which indicates that ho fs not far mway; whilo.the Hon. Aaron F. Parry, sonior counsel for tho Governmont,- Las beon in town moto or loss for two wacks past. Tho usual amount of judielal sparring incldont to auch triata will bo gone through with; all manner of logal rubbish will be lugged in to hin- der the prosocution; for so it secemeth good in tho sight of thie common law. That the dofonse will be thoroughly roprosont- od, it is enough to say that Bonjamin R. Ourtis Is rotained upon that sdo, Thore aro soventy-six motions to dismiss, gen- erally upon the ground of non-jurisdiction, which sliows how thoe Court is looked upon by counsel employed by tho defonse. According to tho Clerk’s book, thero aro fiftoon who have tailed to appear, among whom are Goorge M, Pull- man, President, aud tho Pullman Palace Car Company. Thirty demur to tho bill ag being in- sufiicient, for not spoclfying charges, and boing altogethor multifarious, : The greatest interest is centrod in TIIE ANSWERS, and two or threo of these are indeed interosting. Tracy & Olmsted, of Now Yorlk, send in six, which are noarly identical in their construction ; thoy represent Edward O. Moore; H. 0. Crano, Trustee for W. D. Train; H. O. Crano, Trusteo ; John F. Dillon, executor ; William T, Durant, and John P, Morgan. With the excop- tion of tho last named, they refor to contracts for building, which they say were duly oxcouted by tho Union Pacific Railroad Company, snd cannot bo ayoidod. As to tho correctness of the statements in tho bill, thoy havo nothing to ssy, but very coolly invite proof thereof. Each of tho above answers goca on to take oxception to the bill in three points: that tho bilt shows no nocossity for o rosort to equity; that tho bill wrongfully joins thoir names with others; that the bill docs not show any causo of action sguinst tho defondant in favor of tho United Btales! DMr. Morgan varies the monot~ any of tho contract-song by donying that ho was a financial agont of tho Com- Emly, and also that he ehared with Cornelius . Bushnoll in any profit realized by snid Bush- nell #in the ealo of tho supposed bridge-bonds mentioned in 8aid bill of complaint; and this defondant denics that be is in anywigo nccount- ablo tofiuid Company for any amount whate goovor. BAMUEL T. DANA, of Boston, malces o long anawer, in which he de- nios uny sharo in tho profits of tho Onkes Amos or loxio contracts, and denics any fraudulont managomont of the affaira of the Compsny. Thorois one thing, Lowover, which Mr. Dans admits. Ile says thit, on the 25th of May, 1867, he lent Onkes Amos $10,000 at 6 per cont intor: est for sixty days; that ssid Amos gave him therofor bis promissory noto; that said Amos, a8 security for enid noto, arid to fnduco this do- fondant to moko eaid loan, pledgod to this dofendant 100 sharcs of tho stock of the Crodit Mobilier of America, transforring said stock to tha defondant with the right to take said stock in payment of enid lonn at 095 por sharo atd any timo boforo tho maturity of sald loan. Tho auswer furthor statos that tho note was renowed for sixty duys, snd, boforo it camo duo a second time, Mr, Dana took the stock and surrondored Ames' note, Mr. Dana aftorwards sold tho stock to Josiat Dardwell, of Boston, for 12,500, and hold it as security for Dardwoll’s nofe. ~ Mr, Dana declares that all dividends which wero declared on tho stock wont oither to Mr. Bardwoll or Mr, Amos, ANDREW CARNEGIE begs leave to deny thiat, whilo acting as Direc- tor,o ausisted C. 8. Buslnell in negotiating 2,500 1,000 bridge-bonds, Mr. Carnegio saya that Mr, Bushnell employed him on his own bohalf, and not on account of the Uniow Facifio Railroad Company, to negointo tho kalo of said bridge- bonds in' Europo, whick the aaid Carnogio aid for bia rogular 2'per cont commission. Ho aaya there was no fraud, and, as it was a privato mat- tor betweon himgelf and Mr. Bushnoll, bo thinks the Goverument has no jitst caueo 'of action against hin, : DENAVEN & BROTHER, brokors, say thoy have handled '$2,000,000 to 8,000,000 of the Gifferont securities of tho ZPacifio Railrosd Company, but all in the rogular line of their businoss, and ona vory small margin; that thoy have spont §40,000 in advar- tisiug them, and ate not knowing tb any fraudu. lont ‘uction'in_tho matier. ‘Lhis firm also say thay paid ono Darlon IL, yonis 3500 and Corno Jiuw 8. Busloll 31,000, for tho privilega ™ of buying the differont bonds at 85 por cont: ANSWER OF TNOMAS A, 8COTT, Noxt comes tho great railrond-magnate of Amorica, Thomas A, Bcott, Ho protonds to anewer the bill, but in reality ho anworn noth. Ing; a moro wily, non-committal papor it would bo biard to concalvo. Evidontly Mr. Bcott 1 not much scared as yot, Ho put his answer under fivo hondinga: First—Says ho wan Prosidont of the Union Paciflo Naiitond Company from Marol 8, 1671, to Mauch 6, 1872 Second—'Ihiat, proviaus to the time when thia dofendaut beeamo Prosidont as aforesnid, tho said Union PacificRailrond, Company,ua this dofondant s informed, sold to 0. 8. Busbhell, also ono of the dofendants horoin, £2,600,000 of its bonds, to provido for construsting a railroad-bridgo for #aid Company across the Missouri River at Oma~ 8, ‘Tho third scction rofers to the act of Congress under which tho bonds were issued, Fourth—Atter this defondant became its Prea idont, the said Company concluded ta roduce the intorest to bo paid on’bonds required to con- struct said bridgo, from 10 por cont 108 por cont, E:ynblu in gold. This was done, and 8 per cont nds were dellvered to aaid O. 8. Bushnoll, in lie of tho aid 10 per cent bonds, to the oxtent of $2,600,000, the prico of such 8 per cent bonds Dbeing, howover, tho ssme a8 eaid Bushnell agrood to pay for such 10 per cont bonds. Tho amount lech #aid Company roalized from eald bonds was, as this defendaut believes, ample to provido the means nocessary for the construction f'f tho bridge, which is uow in successful opora- on. Mr, Scott omits totell as to the rolative smounts which woro realized by the Compauy and the snid Bushnell, This would have been yery lnmmutmf; especinlly an our curiosity has becouto excitod by rending the thirty-sixth sco- tion of tha bill, whorein it is stated ‘that Dush- vell was wrongfully pormitted to take 3,600 spocial bridge-bonds'at prices below their true value, and on which he realized lar%u profit. Fifth—Thls dofendant denios that he was in any mauner iuterested in tho nofimuntlou or pur- chaso of sald bonds by said Bushuoll, or that ke sharod with him in" any profit which ho may have realized from the sale of suid bridge-bands, All of which matlors and thinga this dofond- snt i rondy and willlng to maiutain and prove as this Honorable Court shail direct, aud humbly prays to bo honce dismigsed with Liw reavonablo costs and charges in this bohalf most wrong- {ully sustalned. Many of those connected with the Crodit Mo~ Dilier have boon beforo the publie; but, upon in- vestigation, Mr. DBushooll becomos disa- greeebly prominent, Fiftoon yonrs sinco, hewas principally distinguishod for his povorty and numorous family, At tho boginning of tho War, ho eold many patched-up vessels to tho Government ; Lo was ongaged in sevoral wor- speculations, na the stories go, and, liko mauy other enorgetio mon, becamo suddonly wealthy in tho midst of his country's misfortune. James Drooks, Oskes Ames, and others aro mentioned in the bill ns decensed ; from which it would scem that the Credit-Mobilier is very dangerous stuff to handle. It is forbidden fruit. Mr. Bushnell must think of the opening lines to Miss Prontiss’ beautiful littlo poom, in his hours of meditation : e Over tho river they bockon to mo, Loved ones who huve orossod to the other sido, But, for adamantino cheek, cheelt impenotra- DLlo, for effrontery and innocenco which pass all understanding, commend to us CUAKLES Y. NEILYON, OF NEW YORK. Wo learn from him how much 100 shares of Credit Mobilior are worth, Iis answer is the most romarkable and intorosting papor yot pub~ lishod. It reads as follows : ‘This defondant has held stock in tho Credit Mobilier of Amorica aud in the Union Pacific Tnilrond Com}mny on his own account, but for tho accoont of or benoflt of no other porsons than himsolf, aud no other person or persons ‘woro interested in tho ehares of stock in either of the said corporations standing in his namo, oxpopting a8 ho has, from time to time, hypothe- cated or pledged tho emmo for advances aud loans of monoy to him. Tho number of shares in the said Crodit Mo- bilier standing in his uame has been 160, The first 100 shinros of the said stock wero purchased by him about Dec. 26, 1867, togother with 200 shares of Union Pacific Iailrond Company's stock and first mortgago bouds of the Union Pacific Railroad Company, by virtue of an op- tion from Thomas C. Durant, Esq., and, as this defondat understood and bolioved, tha Union Pacific shares and bonds were dividends which bind been declared upon said 100 shares of Crodit Mobilier, and which wero covered by the said option, Tho remaining 50 wore allotted to him, a5 ho understood, in respect to the said 100 sharcs, upon an increase of tho share capital of 60 per cent. K Still itis {ucroasing, and the drive for 1873, which i1 now nenrly afl in, is found to be larger than ihot of any procoding, yoar. Wo bave talken some pains to collact tho statistics of this oar's drive, and fiud that it will not fall far Yolow 500,000 Leod, if, indeod, it doos not reach somowhat bflroud that enormous figuro. Elleworth and Wichita are the two principal re- celving points on the froutier, Our Ellaworth lottor, writton,on the 27th of August, statos that up to thut' date the recoipts at that placo foot up 270,000, Our Wichita correspondent: ostimates that 830,000 have beon driven into tho Btato this year, but figures from othor sources indicato tho drive to bo much larger. Ho claims that 120,000 rendozvoused at that placo, which, added to tho 270,000 at Ellsworth, maks 390,000 hond, bosides about 60,000 recoivod at Coffoy- villo, Chotopa, nnd othor points. _Wm. M. Cox, ILuq,, tho active, oNiciont live-stock agont of the Koniiau Paciflc Railway, hasbeon intimately con- nocted with tho intercsts this scason, and has obtainod reliable statistics from time to timo from differont points,—nil points affectod by the drivo. tho followin, ) Enlamg & grand total for the season of 500,000 cad, . I'his io at least 100,000 more than the drive of 1872, and would probably hnve beon somowhat larger but for the fact that this market has beon swomewhat doprossed during this summor by causes bereafter explained, which deterred many from driving latein tho seaton, who would othor- wise have brought their herds through. Theso cattlo may safoly bo averaged at 315 por hoad on arriving at Kansas soil, and, at that prico, it would take $7,600,000 to buy them. Yet they will bo bought, aud uot for loss than that enormous sum of monoy, aud that, too, botweon this nud tho 1st day of Decomber. No matter at what point they may bo handled first, most of thom come to the Knnsas City market, giving it o magnitude during tho last Lalf of the yesr that no othor market oquals, It is cstimated that about 40,000 hend have been driven into Wyoming aud Northern Colo- rado, and about 20,000 to Nobraska, About G0,- 000 will yot be driven into theLerritories, aud ahout 100,000 will bo wintored in Kansas, loaving about 200,000 head to be disposed of at tho Kan- &ns City market. Of those, from 20,000to 80,000 Lead havo already boon marketed, 120,000 boad will probably bo taken by packors and converted into meats, and about 80,000 head Will be tanked, —ithint is, killed for thoir hidos and tallow, bo- causo of tho low price they command in market, loaving about 116,000 to go to butchers and feed- ors in other Statos than Kansas. From the sbove it will bo secn that at lenst 200,000 aro atill to be handled, mostly at the Kousas City market, and from thenca will be mutrihutud to the different partios to whom thoy will go. But the Toxns cattlo do not compriss the -wholo number that will be handled hore botweon this and tho 1st of December, At least 25,000 of wintered cattle will come from Colorado, all of which are wintered Texans, but few of which aro fit for beef. Tho larger part of thom will go to foeders nlso. Besidos thoso thore will be s large uumber of native cattl, of which no oati- ‘mate can bo made. The tota] number of cattle roceived in our ards last yoar was 386,802 hoad. Estimatos of Tits bost 1ntornmad atodk mun placo it this yoar at 800,000, The total number skipped last year was 235,779, As abovo atated, tho shipment of the stock to. this markot ins Leea delayed, and 1;,:;11 of the drivo from 'Poxas was provented by differsnt causes afflccting the sale. The chiof of those causcd ia founa in tho fact that the Toxas fever has boen prevalent throughout tho Westorn States during the past summor, which has caused the farmors to domand and securs the enforco- mmont of the laws against tho importation of Tex- s cattlo. This has dopressed the demand for feoding cattlo caused the prosent low prices aud dull niarket, ‘dolayod the shipment lero, and caused Toxas mon to keop at home herds thoy intended to drive through. No fault has boon found with the cattle; they araof excoptionally good quality, and an’ abun- danco of buyers with pluuti of money have baon in the market ready to take all offorings; but they havo boen detained from dolug so by tho rofueal of tho farmers to allow thom tobe driven into the feeding districts, This objection will now soon bo overcome, and we may thoen expect to sco tho cattlo move off lively. As soon as frost comes tha danger of the faver is ovor, snd farmers will then want the cattle to food, Thoso driven through have rarcly communicated the disonso; thoy becamo ncolfmated in the drive. The fever bas beon communicated mainly by oattle shipped through by rail, and hence ite appearance in 8o violont a form 80 soon after the beginning of rail shioments, Down in Georgia. s fayette (Ga.)
