Bickerdykae for $42,000, and Biokerdyko made tha conveyance to complainant for ‘ss,oon, sub- ject ‘to the trust deed. The property having thus roach- od ita present highly muddied condition, the in- torost for tho first yoar foll due, and complain- ant paid it, in the dolusivo belief that he wau the owner. Ho knowof tho trust dood, but not of May and Coffman’s agroemont for option to payit off, and nctual offer, under such umumnn!‘ to pay it off, When tho noxt instalmont of inter- eat foll due, tho complainant was sick at his residonce, lonmouth, Warren County, thia Btato, and tho duy was allowed to pass without tho interost being paid. Meanwhilo, it turned out that the Commercial Loan Compeny bad got hold of the mnote and 8t deed, nlthough they bad given no notica to complainant. As soon as complainant’s ad- visor in Chicago could communicate with the complainant the monoy was offored to the Com- mercial Loan Company, but Buchanan said the matter was now in the hauds of their solicitor, Geo. W. Smith, and they could do -uothing, After that, although’ the complainant received no communication from the patics, the latter went so far a8 to advertise the property for sale, which tho complainant heard nothing of until it waa pointed out to him by the morest accident in the paper. The distillors' forty-eight-hour rule suits, which are claimed to involve soveral millions of dollars of internal revenue, have besn dacided by the United Btates Circuit Court of this dis- :mt‘ by & decision in Pahlman v, Raster, Col- ector. Judge Drummond having long sgo said that he considered the forty-sight-hour rule was an unfair one, but that the Buprome Court of the United Btatos would probnblfi rend tho law dif- forently ui ‘himeelf, and as he would not pre- tend to sot himself up above the opinion of tho Bupreme Court of tho United Statos, Judge Davis, of that Court, had better be asked to try the above suits, tho lattor Judge did hear tho casos, and hna now docided Pablman v. Raster in favor of the ruling of the Commis- slonor of Intornal Revernue, His Honor requosted Judge Drummond, in his abaenco, to fuform the counsel that he sustained the demurror of the dofondant simply ; and tho Iatter has done so, without giving reasons, or going into dotails, It s only nocessary to explain that tho forty- eight-hour rule 18 that ruling by the Commis~ sloner of Internal Rovonus, to the effoct that fermontation sball be hold to take place aud bo paid for in forty-eight hiours, although it is con- ceded that formentation takea place only in sev- cnty-two hours.
