A e - charges, enect THE CHICAGO DAILY TRIBUNE: TUESDAY, FEBRUARY 25 1873. ’ ” THE RAILROAD GUESTICH. Oplnions from Various Quarters. LETTER FROX TOE HOX. I C. BURCEARD, asgrso10%, D, 0., Jor. 28, 1873, The Hon. D. W. Dame, Vice-President Jor the IYfth Congressional District of Idinoia State Farmers' Association : > Drag Sm: Your lotter of the 20th inst., in- viting me fo attend and part: pate in tho de- liberations ot the mass-meeting of farmers, called to Do held at Freoport on the 5ih of February next, is received. It public duties hero pormitted my absence, I ehonld not fail to comply with your roquest, snd to meot with you on that occasion. The {mportance of the subject you desire to considor { not overestimated. The burden of our finan- pial and revenuo systems falls most heavily upon the farmers of tho country; but upon the farmore of the Northwest a double portion is Imposed. To enbancod cost of farm production s added incrcased cost of transportation to markets. Treights bavo not been cheapened brt augmented, although miny thousand miles of sdditional reilrond facilities arc annuudly im- roved. Combinations prevent competition: Your mecting, I believe, will be valaable in its raeults. Itwill call attention to the kurdens grisvances our suffering agricnlturists en- dore. Itwill doubtless suggest and consider Diotliods for reliof. Your factwend propcsitions Wil id legielaors in presenting your claims for rudrees, and in providing zud _applying the ooper _and most cortain remedy. Whztever pover State or National Legislaturcs possess to <orrect nbuses and remove theso ovils, should be unhgsitatingly exercised. Whether 'tho most complete and effectusl remedy is to be found in tho leislative regulation, or condemnation and purchise of exisging lines claiming chartered Tights ; tho constroction, by Government or other #id, of competing rnilroads; or tho opening _of other nnd cheaper routes and meihods of treusportation, I will nob digcass, would scck rathaer tho zid of your-counccls, than to direct your deliberations® 4 police power over railroad Corporations, to bo exorcised by the Stato, is not desirable. That chartors granting special gri\‘lleges and valunble franchices, are beyond legislative or judicial control, and can, without hindrance, oppress instead of serving, the public for whodo ugo and benofit they aro_bestowcd, seems unressonable, and should not be couceded unless _exprossly so docided by tho highest tribunal. I am, truly sours, - B. C. Boacuanp. From the Jacksonrille (TIL) Journal. In soswer to 8 qucetion in regard to tho en- forcement of the Railroad las, concerning which there has been 0 much dispute of late, Ti Cizcaco TRIDUNE 8¥8: We lrke it that ruilrosd companies, like all other comranies and_persons, will obey tie lnw when all Qisputea regarding the exisience and vatidity of {lo awarosottled. This conelasion evidently affords Tixz Temuss gt consalation. Althongh {ho Jaogmsgo of ‘Portions of the roport might justify tho infer~ ence, vet we do not beliove that tho Maesachu- eetts Commissioners intended to edvise that oll railway legislation shonld be_sbandoned, for the Teason ibat reilrond corporstions have notorious- 1y been in the habit of corrupting Logislaturcs. , it sufficiently sppears that the ommissionors arc really in har- inlation of this Staté on the in freight charges be- tween differcnt communities: Ttmust bo sdmitted that there are serious difficultiesto ba encountered in framing & proper bill for establishing reasonable maximum freight ~charges. For thisreason the Legislaturo of this ‘Biate has sa yet, with referenco to {reight only a law which does not fix tho maximum rates, but is_simply, designed to vent sbuses perpetrated by railroad corpora- ions in charging heavier rates o intermediato than to competing points, and to punish thom ;< for extortion practiced on local business. Such ragulations are clea:ly within the police power of tho State. i Our sct of April 7, 1571, i9 as follows : Bs it enacted, &c., That no railroad corporation ed or doing business in this Btate undcr any nct of incorporntion or general law of this State now in force, or which may bo hereafter cnacted, ehall. churgo or coilect for the tranrportation of goods, merchandise, or property on its €aid road, for any distance, the £ame, nor any larger nor grester amount es toll or ‘compensation than is at the same time charged or col- Jocted for the transportation of eiwmnilar quantities of —+the samo clase of goods, merchzndise, or propesty;orer ~ s greater distance upon tho eame road. - 3 ' While the Massachusetts Commissioners argue that legielation limiting charges to so much per mils for cach pessenger, and for each tonof freight, economically coasidered, is fouuded on 8 wrong principle, yet they admit the propricty of our freight law. bé adding : ““ OF cource this economical principle mustnot be confused with the abuses perpetraled by the railroad corpor- tions in cliarging heavier ratesto intermediate than to competing points, or with the exfortions at times practiced on local usiness.” : . Inviewof thisstatement, neither Tax Tnz- - uxE, nor the railroad’ corporztions of this State, .--can derive much consolazion from this report of tho 3Massachucetts Commissioners. Whatever mey bo thoir notions es to the varions plsua de- vised for ostablishing maximum charges, - they unquostionably ndmit, 88 all right-minded perzons must, that tho abuscs perpotrated by the railrozd corporstions in charging heavier maica to intermediate then 0 compoting poinis, fad tho extortions pructiced by thom on 1 businesg, ehonld, if possible, be preveniod by legislation. And the prevention and punishment of such abuscs and_oxtortions are tho sole pur- pose and object of thoact of April 7, 1871, tko constitutionality of which is now in question in the Supremo Court of this State. . From the Kewance Independert. The important question in ths controversy be- twesn the railroads and the people, is, Go their charters plece them aboye or beyond the control, or independent of, the laws of the Btate? In this is jnvolved the old doctrine of “vested rights,” by which itis claimed that franchises - gratod by one Legisie ture cannot bo interfered with by a subseguent one. B ‘This is the whole -question at iseue in the Present controversy, and it must be decided by 1hs courts, end, of course, will be carried to tha . -court of Jabt resori—the Supreme Court.of the ~- United States. Skould thst decision, whenever mede, bo in fevor of the people, then there will be little difficulty in enforeing the lawa against the railroads. Should it be decided in favor of the railroads, then the people will have to look to other measures for emancipation from rail- rosd rule, which the. faturc must develop. That the people will quietly submit to a tyranny %0 oppressive es.that imposed upon them by these goulless corporations, is bardly probablo: Until sach decision is reachied, the only remedy i the enforcementof the laws by the legally constituted suthorities of the State. How far the railrosds will resist those, romasins to .bul from somo of be secn, but ghould tho Legiclature pass efticient IuwsI and officers g!‘:f anfil;')ant norvo and “backbone” be appointed to enforce them, it seems y probablo that tho railroads will resiet them. It certainly would not be policy for them to do 80, if tho Execative of tho State ehould manifest deter- mination to enforco them at all hazards, as he would be bound to do by his oath of offica., 'The idea of individuals or mobs atiempting to compel railroad conductors to take s less fare than that prescribed by the Company ia simply absurd. As well might o mob underiske to en {force the Temperance law which some individual o company ia conslantly violating. Mobs aross ell times, and under circumstances, danger- ous, and of doubtfal expediency, and shoald never be tolerated for 5 moment, oven in cases of great provocation. How much less, then, in the "X;asenc contest, where no possible good can rest §except 8n occasional free ride) to any one. If the railroad companies cannot bo renched by law, there is an ond of the argument, 80 far 28 thoy are concerned. p From_the Rock Island Arqus. __The farmars should organize clubs or granges in evary township in Ilinois, and concentrato their power for _their own protection, regardless of political parties. should be permanent. They should roguire old rale to bo rovived and practiced, viz.: that no public corporation has any ‘vested rights which the people cannot recall when the public good requircs it; that no Legislaturo has tho power to deprive tho people of that right, and ony act of any Legislaturo contrary to that prin- ciplo was never law, but was iliegal and void from the date of its passage. ’I’hoa' should take especial care that no man 1s elected to any oflica who is opposed to_their interests, Thoy sl:ould insist upon a written answer from all candidates as to their action affecting their interests. 'They shounld insist on a_radical revision of the tariff, ond & relief from the oncroms bur- dens it imgoua upon_the interests of - agri- calture, and upon ndjusting it to a_strictly Tovenuo basis, thus facilitating a mora free cx- nhn.ng‘n of productions with zll parts of tho world. and thus opening & relisble market for their Burplos products. In othor words, thus ensbling them to sell where theycan eell dearest, snd buy whero they can bny cheepest. They ehould take especial caro that no man is elecied = Judge, or o member of the Legielature, or a member of Congress, who does not hold to these views, and who will not pledge himself to carry them into practice. They must not_expect ini- mediste relief from their burdens. It can only come after years of patient, persistont work. 1f the farmers are not prepared to study their own intorests and to keep up thoir organizations, and work for their interests, then things will - g0 on 18 nt present, with class legislation controlling the country, and tho rich growing richer and the Ppoor growing pocrer. the From the Wenona Indez. Tho following is'one among othor rosolutions aseed at & so-celled Farmer's Convention at Princoton, on Saturdsy last: That thoso pewspapers that do not support tho cause of the people in this contest with the railway ‘monopolies, but take sides with those aggressors upon ihe peaple’s rights, are unworthy of our patronxge, and ehould receive nmo countenance or support from a putriotic people, n conversation with 8 physician recently, ho remarkod that he hod (a short time previous), visitod the Insune Asylam,—spont sovaral wooks there, and sinco that timo'was thoroughly eatis- fled in his own mind that “a very emall portion of the crazy pooplo over went to the asylum.” After roading the sbove_resolution, the remarl Boomod very forcible. The eetirg created & great deal of excitemca.t, and 1 mass convention of all opposed to raitrond cx- tortion and monopoly is expected to bo called ot an early day. K It is a dull politician and 2 duller citizen—no matter what their former beliefe—who cannot discern that a quick and perfect organization of & party upon the bagis indicated, is the' one thing na in this hour of the nation’s peril from the stupendous frauds of the day. For our part, we g;nposu not to cling to the ghosts of the past, but will go up with tho moving masses which favor prompt_action to cure present ills, Itis high time, wo think, that all men should take stand for tho_reforms demended; and not allow the corruptionists to control themachinery g{l g%vnmmem o moment longer if it can bo clped. s We proposo to act in the fature for the fataro; snd to disrogard, if noed be, the old party tics which would bind us to the dead issues of the past. In the present crisis, there can be but two wides to tho question, and men must _be arrayed either for or against tho Wrongs now transpiring. Tho Springfield movement is a timely one. A SINGULAR STORY. Hoqw o JMeu Lost Dis Health, His Wife, and Rildren by Going to the War in 1862— Giving Him Up for Dead, Nis Wife Con- tracte Another Marricge, and Removes to Chicago. A singular story of the Enoch Arden school comes to ns from Now York, baving & local in- terest for Chicagoans, inasmuch 8s the Annie Loo is living, or supposed to be living, in Chi- cago. Tho story i s briof one, and to this ef- foct: Isaac Dovoe was & laborer, a marricd man, with several children. In1862he enlisted in tho rogalar army snd went South, for pur- poses well lnown to quite a number of tho ‘“Colonels” and “Captsing” who figure so largely in ward politics. In the early duys}of tho sioge of Petersburg, he was captarad by tho rebels, when all commu- nication with his wife, to whom he had written regularly, ceased promptly. He was transforred over und over again, unhl the cossation of the war, whon ho was releasod, utterly broken down in heslth by the treatment ho received from tho Chivalry. Ho was compolled to go iato hospital st Now Orlesus, having provionsly written to Lis wife. During tho cight months of his stay in hoepital he received no reply from his wife, 50 o gavo herup for dead, end, havig racovéred somothing like health, ho began light employ- ment on 8 Mississippi_ stesmbont, but was agaln compelled to go to hospital, whero ho romained for one year. ~Having by this time fally recov- ered, he obtained employment eecond timo on tho river, and there remzined until s fow weeks ago, whon ho returned to Poughkeepsie to find his wife. His_wife, mesntime, had loared that he wasdead. The support of bergelf and children fell upon her, and she was roduced to absolute want. She left her children with her brother st Kingston, N. X', and found employ- ment as & factory operative in Cohoes, N, ¥. In 1868 sho Toturned to Poughkecpsie, and thers marricd en old lover named Barney Dovlin, and Jived with him in New York until tho spring of 1870, when the family came_to Chicago, which i8 tho last known of them. hen Devoo arrived in Poughkeepeio, ho kad somo little dificulty in atablishing bis fdontity, but, having dono"so, Te loarned the story of his wife's second mar- riage. Here onda tho Enoch Ardon story. Ho a5 quite philosophical about it, but dotermined to God his chiidren and keep them. If his wife was living happily with ber new husband, he would not interfere, but ‘ho must have his children. ~Whether ho has found them in this cityor not is not known.
