Ho urged thnt the hoaring of the motion should be sot for tho 24th March, the day sot for the final hearing, so that tho whole matter might como up together. Mr., Smith sald Lo did not ask the Court to do- cldo on any such quostion s to whether the vil~ lage had passed rensonable ordinances or other- wiso. What thoy did ask of the Court was to give thom pormission to try the matters of law. They werosurely ontitled todothat. Theybolioyed thoy could show that tho Compnny was carcless in ite business ; that tho meroe fact of the Com- pany Doing n nuisance wos not all that tho village had to complain of, but that it was unnocessarily o nu’sance in consaquence of carelossnoss, This waus & matter of fact, and law, and was not for tuis Conrt to puss upon. It was for a Court of law to decide. It was just and nocessary that the. «<defendants should have an opportunity to prove those allogations, and he thought they had a \awrlect right to nek the Court for the moans of oing #0. ~ With the injunction : weighing over thoir heads, as this was, thoy could not take any such step. No one would say, no matter what the vested rights of tho Company might be, that tho Logislature had given 1t & vested right to carry on its business in such a manner as to make it a'nnisanco. If they bad asked the Court, by this motion, to docide that the Company had vio- Ia‘ed the villufin ordinances, or if thoy bad asked the Court to adjudicatoupon sny question of lnw, or fact, thoy might be prepared for objection an¢ refuenl; but, on the contrary, all they sought to :‘btmn was tho right of trial y law on such ques- ong, The Court said, if Lo undorstood it aright, that the object of tho motion was to obtain such & modification of the injunction as would securo tho parties onjoined from being injured in the meantimo. If'it was right for the Court to hear and pnss upon such & motion, ho thought that it should bobefore tho finnlllnulnfi of tho cause, ‘becauso if, upon tho hearing of the motion, the Court should think that the injunction should be modified, the defondsnt would not, after all, got the benefit of tho decision of the Court, in- asmuch as, if n decroo should bo made which tho complainant should appesl from, that appeal tould keep the injunction in full force aa it nmow was It appoared to him that this wns the {x‘:flur way of looking at tho matter. Poseibly the Court might have no objection to the granting of thia mation when it camo on to be heard, He had no objection, at all evonts, to the parties having an opportunity of tosting their rights at low.
