The matter of tho bankruptey of Ernst Brandt camo up ngain, yesterday, in oneofita numorous phases, in the United Statos District Court. It will bo remembored that Mrs. Braundt was ro- strainod by injunction from collecting tho rents of tho real estato which had boen conveyed to hier by Lier husband ; sud that Judgo Blodgott, of tho Diatrict Court, rofused to dissolve this in- junction on the motion of tho counsol of Mrs. DBrandt. An appeal way takon from this do- oision to Judge Drummond, of the Unitod Btatos Orcuit Court, by petition for review. - An acoount of tho argument on this appoal, by Mr, Bontetto for the oreditors, and Mr, John W. ‘Lla for Mra. Brandt, sppeared in Tue Tnmmuxe somo weoks ngo, also the docision.of Judgo Drummond, modifying the injunction aud allow- Ing Mra. Brandt & provision out of the ronts, and this declslon, which appeared in this coluinn only, created cousiderable oxcitemont among those interosted in bankruptoy. Burrows appoarod for tho dofendant, Brandt, The testimony, which was voluminous, had boen tkon bofore Rogister Hibberd, and a4 road to th> Court, and several acts of bank- ruptey were allogad. , Mr. Cook, in his argumeont on behalf of tho creditors, claimed that tho allowing the wife to roceive tho ronts of tho real ostato foralong time previous to tho commoncoment of theso proceedings was an act of bankruptoy, the de- teudant being proved to bo insolvent, Also that tho sale of & stock of hats and caps, tostified to, wasin fraud of croditors, and an ack of bank- tuptoy ; and claimed other acts of bankruptoy on account of preferred paymonts, and that do- fendaat was largely insolvont. Mr. Els, for the dofendant, argued that tho recolving of the ronta by tho wifo was not sn aot of bankruptoy, becauso Judge Drummond had held thet somo portion of thosc rents be- longod to the wifo, porhaps all ; and uutil the smount is ascertainod, this Court will not as- sumo that the ronts woro tho property of the de- fondant for the purpose of helping him into bankruptey; and again, tho rents were usod for the support of,the family. Tho fact that tho wifo used the defendant's money to support the fam- ily with, cannot bo held an act of bankruptoy, That na to tho ealo of the stock of goods, it did not hinder or delay creditors; they wore bettor *.off than before. No insolyency was proven ; there wore no preferoncos. It is a proceeding mercly to compel payment of some gn'btu, fish- ing for ncts of bankruptoy as thoy went. aloug, - "tho Court, in his docinlon, sustained thepoint mado by Mr. Eln sa to the rents of the real es- .tate—deciding thatthe rents being used for tho gupport of b6 femily—ond, a8 tho family mant live, it made no differonco to tho creditora whethor the means came from the business or these rents,—this conld not be an act of banlk- ruptoy. But ho held that tho offect of the salo of tho stock was to hindor creditors, and that somo of tho payments spocifying them wore proven to bo preferred; and, thorefore, adjudi- cated defendant a bankrupt. It is underatood that this decision also will bo taken before Judge Drummond by appeal. BANKRUPTOY MATTERS. Leowls W.
