WASHINGTON, Nov. 21,—It may come as a surprise—and possibly as a dit&ppointment—to Colonel Billy MXchel! to discover that, upon con- iC icon in his present trial, he will iy not be “fired” out of the army. 7 But“as a matter of fact, it was learne@ from some of the oldest of- ficers in the service that there never has been a dismissal of an officer for the offenses with which Colonel Mitchell is charged. The army, therefore, has been surprised at the public discussion of the not to say the probability, colonel will be made to “walk the plank’ unless President Coolidge shouid step in and commute the ex- pected sentence of dismissal. Colonel Mitchell’ is charged with conduct prejudicial to good order and miltiary discipline. Such a charge, according. to long army precetont, does not carry dismissal as a punishment, It is rare, indeed, that a high of- ficer of the army ever is dismissed. When he is, it is for conduct un- becoming an officer and a gentle- man. No such charge has been leveled against Colonel Mitchell. Nor has there been an allegation of insubordination in the accepted meaning of the term, Colonel . Mitchell never has refused to carry out instructions, he has never in- cited to mutiny or rebellion, despite the fiery lanugage which has been accredited to him. “The defense has shown that the colonel’s statement, lambasting the war and navy deé- partments, caused scarcely a ripple on the surface of military Hfe in angvaround San Antonio. where the jabs cron was stationed at he time of his outburst. Washing- ton seems to be the spot where the explosion was the loudegt. The mildness of the punishment likely to be meged out tq Colonel Mitchell, if found gullty, is likely to diminish public interest in his fate. It also means that President Cool- idge probably will not be called upon to exercise any drastic power as final reviewing authority. <A reprimand and the loss of a few numbers in grade probably would be approved by the president rather speedily.
