DAYTON, Tenn., May 23.—The case of John T. Scopes, high school teacher, on the charge of violating Tennessee's “antl-evolution”’ law, promises to ,become a great legal tle. Willam Jennings Bryan has offered his services to the prose- cution; Clarence Darrow and Dudley Field Malone, lawy tional reputation, are eager to serve the defense; and money ts coming in from all over ghe country to afd both sides. Scopes 1s not worrled regarding the ~utcome. He courted arrest un- der the new law so that it could be tested. Even Nis friends are hoping that he will be convicted, so that his case can be appealed to the supreme court of the state, and, if necessary, to the United States Su- preme court. The case has much more than a local, or even a state, significance. Scope was arrested for teaching his pupils what the best scientific minds of the day belfeve to be the true story of the descent of man. These scientists do not deny the existence of God, but do not believe that God created.man in His image, according to the Biblical account. The persons responsible for Ten- nessee’s law aver, on the other hand, that the Biblical version is the only true account of the birth and progress of man. Other States in Fight, There is no doubt that Scopes has violated Tennessee's law; the question is whether that law is con- stitutional. It confilets with two phases of the Constitution, it is de- clared; that {s, those parts having to do with freedom of speech, and freedom of worship. Tennessee is only one of the states where there are “anti-evolution”’ laws on the statute books> but it promises to become a battleground for all of them. Thus Scopes, a quiet, unassuming high school teacher, will become a symbol. In Oklahoma for more than two years it has been impossible to teach the “evolution theory” in the public schools. In Florida the legislature passed a resolution advising school boards not to employ instructor who taught “Darwinism,” and a bill been introduced making such in- struction unlawful. In Texas and Kentucky the lower house of legisla ture pased anti-evolution bills, but the upper house failed to carry the measure—in Kentucky by the mar- gin of one vote. The North Carolina Board of Education will not employ teachers “who believe in evolution.” Bills are pending or about to be presented in Mississippi, Georgia West Virginia, Arkansas, Iowa, Illi nois, North Dakota, Minnesota Oregon and Arizona, Bible-Reading in Schools Involved.
