LEGAL NOTICES ORDINANCE NO. 504-A, An ordinance prohibiting , the unlawful possession, manufacture, transportation, giving away, or sale of intoxicating liquor within the limits of the City of Casper, Natrona County, State of Wyom- ing. BE IT ORDAINED BY MAYOR THE AND CITY COUNCIL OF THE CITY OF CASPER, WYOMING: SECTION 1. This entire or- dinance shall be deemed to be an exercise of the police power dele- gated by the statutes of the State of Wyoming. for the protection. of the; public health, peace, safety and morals of the City of Casper, and all of its provisions shall be liberally construed for the accom- plishment of these purposes, SECTION (1) When used in this ordinance the word “li- quor” or the phrase “intoxicating liquor” shall be construed to in- clude alcohol, brandy, whiskey, rum, gin, beer, ale, porter and wine, and in addition thereto any spirituous, vinous, malt or fer- mented liquor, liquids and com- whether medicated, pro- » patented, or not, and by whatever name called, containing one-half of one per centum or more of alcohol by volume w*'*h are fit for beverage purpo. -s; Provided, That the foregoing de- finition shall not extend to de- alcoholized wine or to any bever- age or liquid produced by the pro- cess by which beer, ale, porter or wine is produced, if it contains less than one-half ef one per centum of alcohol by Volume, and is made as prescribed in Section 37 of Title 11 of the Act of Con- gress commonly known as the “National Prohibition Act” pass- ed on October 28, 1919, and is otherwise denominated than beer, ale, or porter, and is contained and sold in, or from such sealed and labeled bottles, casks or con- tainers as are in conformity with such régulations as may be pre- scribed under the authority con- tained in said. ‘National Prohibi- tion Act.” (2) The word “person” shall mean and include natural persons, 9 associations, co-partnerships and corporations. (3) Words in the singular num- ber shall be held to include their plurals, and vice versa. (4) Words in the masculine vender shall be held to include the femininerand neuter. (5) The term “conyiction” shall be held to include a “plea of guilty” entered in open court. SECTION 38. It shall be un- lawful for any person to manu- facture, sell, barter, transport, import, export, deliver, furnish, or possess any intoxicating liquors, within the limits of the City -of Casper, except as authorized by the “National Prohibition and the “Intoxicating Liquer Laws” of the State of Wyoming. SECTION 4. It shall be un- lawful for any person to have in his possession, or under his con- trol, any utensil, contrivance, ma- chine, preparation, compound, tab- let, substance, formula, direction or recipe designated or intended for use in the unlawful manufac- ture of intoxicating liquor. SECTION .56 Any room, house building, boat, vehicle, automo- bile, structure, or place where in- toxicating liquor is manufactured, sold, given away, or bartered in violation of this ordinance, and all intoxicating liquor and property kept and used in maintaining the same, is hereby declared to be a common nuisance, and any person who shall maintain such a common nuisance shall be guilty of a mis- demeanor and upon conviction thereof shall be punished as pro- vided for in Section 11 of this or- dinance. SECTION 6. It shall be unlaw- ful for any person to have or pos- sess any intoxicating iiquor or property designed for the manu- facture of intoxicating liquor in- tended for use in violation of the provisions of this ordinance, or which has been so used, and no property rights shall exist in any such intoxicating liquor or prop- erty. A search warrant may is- sue as hereinafter provided, and all such liquor, the containers thereof and such property 50 seized shall be subject to such dis~ position as the court may make thereof. SECTION 7. In any complaint, information, or indictment for the violation of this ordinance, sepa- rate offenses may be united in separate counts and the defen- dant may be tried on all at one trial and the penalty for all of- fenses may be imposed. It shall not be necessary in any complaint, information, or indictment to give the name of the purchaser or to include any defensive negative averments, but it shall be suf- ficient to state that the act com- plained of was then and there pro- hibited and unlawful. SECTION 8. The possession of intoxicating liquor by any person not legally permitted under this ordinance or the “National Pro- hibition Act” or the. “intoxicating liquor laws of the State of Wy- oming” to possess intoxicating li- auor shall be prima facie evidence that such intoxicating liquor is kept for the purpose of being sold, bartered, exchanged, given away, furnished or otherwise dis- posed of in violation of the pro- visions of this ordinance; but it shall not be unlawful to possess liquors in one’s private dwelling while the same is occupied and used by him as his dwelling and such liquor need not be reported, provided such liquors are for use only for personal consumption of the owner thereof and his family residing in such dwelling and h bona fide guests when entertainec by him therein; and the burden of proof shall be upon the pos- sessor in any action concerning the same to pri that such li- quor was lawfully acquired, pos- sessed. and used. SECTION 9. Whenever com- plaint is made in writing, verified by the af: it of the complain- ant, to the Police Justice of the City of Casper, thut any intoxicat- ing liquors are being manufactur- ed, sold, kept for sale, possessed, distributed, furnished or given away contrary to the provisions of this ordinance, or in violation of any of the laws of the State of Wyoming, or of the United States, in any house, building. de- pot, freight house, express office, store-room, boat, vehicle, ‘auto- mobile, receptacle, or any other place whatsoever, particularly de- scribing and designating the same, such police justice shall thereupon issue. a warrant directed to the proper officer commanding him to search the premises described and designated in such complaint and warrant, and if such liquors are there found, to seize the same together with the vessels in which said liquors are coritained, and all implements, furniture and ve- hicles kept or used for the pur- pose of violating, or with which to violate this ordinance, and to safely keep the same, and make immediate return on said warrant. SECTION 4. That probation or parole shall be granted or or- dered in the case of a person in- fected with venereal disease only on such terms and conditions as shall be recommended to the court by the local health depart- ment in order to insure medical treatment therefore and prevent the spread thereof.
