That said chattel mortgage pro- vides, among other things: The said C. B. Cunningham, mortga- gor, does hereby convenant and PAGE ELEVEN agree to and with the said W. L. Simplot, mortgagee, that in case of default made in payment of the above mentioned Promissory note, or in case of his attempt to dis- pose of or remove from said coun- ty the aforesaid goods and chat- tels, or any part thereof, or if at any time the si mortgagee, or its assignee, should feel unsafe or insecure, then and in that c: it shall be lawful for said mortgagee, or his heirs or assigns, to take im- Mediate and full possession of the whole or any part of said goods and chattels to provide for and sell the same according to law, or so much as may be necessary to pay said note, together with the interest thereon, and all costs, torney’s fees and all other exy - es touching the same, and out of the money arising therefrom to pay said note, interest, costs, at torney’s fees and all other ex penses as aforesad, rendering and paying the surplus, if any, to the said party of the first part. This chattel mortgage is intended for security, and the amount for which this instrument is intended as se- cory as aforesaid is the sum of $880.00, with such interest as may accrue thereon, according to the tenor and effect of the promis- sory note above described. That $760.00 has been paid upon said note and mortgage; that there is now due and owing said mortgagee $120.00 principal, and $142.80 inter en August 22nd, 1924, the first day of pub- lication. That the same has not been paid, or any part thereof, and that the said C. B. Cunning- ham has defaulted and is in de- fault in the conditions as con- tained in said chattel mortgage, as herein stated , That the under- signed, therefore, by power and authority in him vested intends to foreclose said chattel mortgage to pay the sum of $120.00 principal; and $142.80 interest, besides ex- penses of attorney's fees, labor, advertising, selling said property, and other costs incident to the care and preservation of the above described property during the process of foreclosure. Wherefore, the said mortgagee, as herein prescribed, will sell the same at public auction, on Satur- day, the 6th day of September, 1924, between the hours of ten o’clock A. M. and four o'clock P. M. of said day, said sale to com- mence atten o'clock A. M. at the Court House, Natrona County, Casper, Wyoming; the whole of the above described property to be sold to satisfy the above men tioned ‘indebtedness, together with all'costs and uttorney’s fees, as aforesaid. Said property will be sold at that time and place afore- said, by the Sheriff of Natrona County, duly appointed agent for mortgagee aforesaid. Dated at Casper, ibea's 5: ge 1924. . L.
