CHEYENNE, Wyo., Aug. 31.—Is « “flunky” in a bridge gang camp who is wouride by the camp cook| during a brawl entitled to insurance | from the Wyoming Workmen's Compensation fund? ‘That question may go before the} State Supreme court as the result of the refusal of State Treasurer Snyder to pay a compensation award made to Thomas A. Middaugh by Judge C. O. Brown of Douglas. Snyder contends that the circum- stances contributing to Middaugh’s) injury were not of a character that) entitles him to state insurance. He| has referred Judge Brown's order of} award to Attorney General D. J Howell for that official's opinion. Middaugh was employed as & waiter at a bridge construction eamp in Converse county. On May| 6, 1928, he became involved in a brawl with a cook and the latter,/ seizing a butcher knife, stabbed) Maddaugh in the calf of the right | leg, the injury causing temporary | total disability. Middaugh applied for compensation from the Work- men's Compensation fund and Judge Brown awarded him $54.44 for May and $67.50 each for June and July, making a total of $189.44. Movie Writer And Director Is Found Dead SANTA MONICA, Callt., Aug., 81. Herbert Jones,.37, motion picture writer and director, who was found unconscious in his home here yes terday. died in a hosp{tal late last night His feet and legs were badly burned when he was found, although there was no sign of a fire in his home or near it, and near his bed upon which he lay was a tube from which six tablets of a sedative drug had been removed. He was said to have come from New York. He had been living alone here. His wife, living in San Francisco, has been notified and is believed to be on the way here. Jones was found by a friend, J. F. Hattiford, of Los Angeles, who entered the house when there was ne response to his knocking on the @oor.
