As a preparation for his judicial duties he was engaged in compiling and annotating the Genera] Statutes of the state at the time he was ap- pointed to the District bench. Having demonstrated his fitness and ability on the District bench, wher a vatancy occurred, he was promoted to. the Supreme bench. No Democrat who really is qualified would even run against him. When a Judse has this, as Judge Tidball has, he is entitled to a premotion, but asidé from this the people should avail themselves of the services of such a man, now that they have the opportunity. In fact, it has been the custom in the part, in a large measure, to promote the District Judges to vacancies on the Supreme bench. The law provides for the election of judges of the Supreme and District Courts “regardless of political affiliations.” The spirit and purpove of this law is violated as effectively by a partisan elec- tion as by a “political” appointment.
