Mr. Gibbens was an old-time resi- dent of Casper and had been staying with Mr. Pattee for two years. He had had a great deal of trouble with his heart and had been under treat- ment by Dr. Dickerson, who many times had warned him that he must not attempt to do any work at all. After a lengthy hearing in justice court this morning Jadge W. E. Tubbs, quashed the case against Charles F. Miskell, part time member of both po- -@ and sheriff's departments, who was charged with criminally assault- ing Lou C. Muchow, North Casper pool hall owner with a gun on April 1. Judge Tubbs announced that while there was a great mass of evidence in the case that very Iittle of it was good and the evidence against Miskell’s al- leged assault was for the most part mythical. The state prosecuted Miskell on an amended complaint prepared by tl count, office after the first fiskell on @ faulty y Attorney LG. complaint @ McCann had failed. The amended complaint justified the case being brought to trial but the mass and tenure of evidence intro- duced tn the case was in support of the fact that Miskell had conducted himself in a manner becoming an of. ficer. The defense of Miskell was handled by Judge C. D. Murane. From deductions of evidence ft is evident that the only manner in which Miskell erred was in not effecting the arrest of several persons whom he caught in the act of engaging in a so- ciable game of chance in an institution alleged to have been operated by Muchow. fice of the doctor. It was while there he had a second attack, which was fatal. The body is being held in the Shatf- ferGay chapel pending word from Mrs. Myrtle Williams, sister of the deceased.
