Allen, alienist, and member of the Les Angeles county lunacy commit tc, testified that in his bellef the de fernaant was insane. Dr. Allen said he based this opin- fon upon observations of Burch in jafl and in the courtroom: A hypo- thetical question was put to him by Paul W. Schenck, defense attorney, in which were detailed alleged ebanges in the defendant's habits during the past three years. Dr. Al- Jen said that assuming these things were true, they strengthened his opinion as to Burch’s mental condl- tion. He said that in his opinion tf Burch killed Kennedy, he dd not know the nature or consequences of thet act. On cross examination Dr. Allan said he did not feel “quite able to clas- sify” tho state of mental deteriora.
