BURCH TRIAL IN FIFTH WEEK LOS ANGELES, Dec. 19.—The fitth week of the trial of Arthur C. Burch, charged with the murder of J. Bel- ton Kennedy, began in +t. Superior court here today. The serenne was prepared to open its case, but the state @ecured permission to offer another witness, although it had rested last week. Before the state's new witness was called, however, Col. H. B. Her- sey, chief of the United States weath- er bureau here, took the stand for the defense so that he might be excused from further attendance. Colonel Hersey was asked to de- scribe from his official records the sort of weather and light conditions that existed on the nights of August 4 and 5 of this year. Witnesses had placed Burch in Beverly Glen, the place of the shooting, on both of these evenings, The shooting occurred Au- gust 5, late at night. Colonel~Her- sey said the moon set at 7:25 the even- ing of August 4 and at 8.08 the even- ing of the fifth. He saifl both nights were clear. Loretta Kidd has a strenuous evening, high- diving into bed whenever “Alfred” ap- pears at an unexpected moment to get the day-old baby. Bennie Kirkland, as the colored maid, appears opportunely, sings a song, does his funny steps and gets his full quota, of laughs as usual. Hoyt Smythe is very clever in his song and dance solo, while the chorus and Al Darr, Loretta Kidd and Ben- nie are gratifying in their song num- bers. In fact, good singing and good music are features of this show. The Squirrel Quartette is back as a special attraction and Rex Mayne, popular local singer, delights with a couple of his best songs. The picture, “Up in Mary's Attic,” with Eva Novak and Harry Gribbon, is a long and very funny comedy. The setting is at a girls’ seminary where athletics are much in vogue. Next Saturday there will be a free matinee, Christmas tree ‘n ever'’thing for the kiddies. More than a third of the seats have already been reserved for the big midnight frolie New Year's eve.
