FRIDAY, AUGUST 19, 1921. SELF-DEFENSE PLEATS MADE BY HARRY NASH Wyoming Cowboy Says He Shot and Killed Utah Man After Latter Threatened Him With Gun. FLAGSTAFF, Ariz, Aug. 19— Harry Nash of Hillsdale, Wyo., on trial here for the murder of Martin Schwab, Payson, Utah, traveling salesman, in April, 1920, from the witness stand told his story of the aying of Schwab his testimony both » direct and cross-examinaticn ad- hering closely to the confession and claim of self-defense he made soon after, his arrest last January. Tho witness said he wan in-no condi tion fo walk, as he was suffering from blood poisoning in one foot, and so informed Schwab. “If I stay here, you'll stay, too," Nash testified he sald to Schwab: “I'll let tho air out of your tires.” He bent to let air out of the tires, Nash testified, whereupon Schwab putled a .32\calibre gun and covered him, exclaiming: “You're another of those damn cowboys. You wouldn't be the first.one I killed.” To this, Nash testified, he retorted: “Is this the way you damn Mormons make your living?" With this retort, Nash testified, he jumped to one side and pulled his gun. He and Schwab fired simultan- cously, he asserted, and then he fired again, dropping Schwab. Nash testified that, he was very much afraid and waited half an hour before he could bring himself to touch Schwab's body, but finally lifted it into the automobilé and drove back to Flagstaff, intendi~<: to report to the sheriff. He lost his nerve, how- ever, he testified, and ‘nstead of go ing to the sheriff's office drove to his home.
