GE IND NOFCE DECISION PROMEES— EXPEDITION IN ISSUING VERSES Rejection of Protest on Salt Creek Land Indicates: That Operating Rights Will Be Granted and Ad- verse Claims Will Be Left to the Courts A decision of ‘far-reaching significance, in the opuiec of legal circles, is contained in the refusal of the general land office to recog-| nize the protest filed by,M. B. Burke and the Eclipse Oil Company | against the granting of a relief lease by the government to the Ohio} Oil Company and the Columbine Oil Company, as lessees, and Robert | G. Taylor as owner and lessor, on Salt Creek, on which the last named had made application for a lease under section 18 of the leasing law. Aside from its imporance with respect to the claims involved, according to attor- neys, the decision of the land office. signed by Clay Tallman as commission- er, indicates that protests will not be permitted to delay the issuance of leases inso far as the government is able to establish the justice of conflict- ing claims, but these disput and con-) flicts are to be left to the courts for final determination. Claimants fav- ored by the government will thus be able to take advantage of operating rights pending adjustment by the courts should the contestant take ad- vantage of his right to secure redress through this avenne of justice. Prior and superior locaions rights under the oil placer mining law were claimed by M. B, Burke and the Eclipse Oil Company in protesting the claim of the applicants. The land of- fice decision does not support this claim to the extent that it was found that the copy of the protestant’s lease @id not describe the lands under dis- pute; that Robert G. Taylor is the ecord legal title to the ‘owner of the mining claim and that the protestants Made no shi g in their claim of having “drilled one or more oil or gas wells to discovery,” as required un- der section 18 of the leasing act, un-| der which the protestants’ claim was asserted. | The rejection of the protest dispelled considerable anxiety in oil circles that, disput and controversies might tie up the issuance of leases indefinitely. | For the benefit of those who appre-; ciate a detailed statement of the decis- jon, the document as just received by Attorney H. Protestants make further allegations purporting to show their qualifications to receive a lease ‘und Bection 18. Said protest is hereb; jected, sub- ject to the right of appeal within fif- teen days from the date of receipt of notice hereof, for the reasons follow- ing: It is noted that Exhibit “A” in the protest, purporting to be a copy of pro- testant’s lease for said lands, does not describe said lands, but _applies to other lands, but as the abstract of title} does show a lease under the same date as the lease set up in Exhibit “A,” it is assumed that this is merely a mis- ta Under the provisions of Sec. 18 of the leasing act the persons entitled to relief leases are those who own and hold the record legal title to the min- ing claim on which the application for reliet is predicated. Applicants Ohio Oi! Company and Columbine Oil Company join with them Taylor, who, according tothe abstract, is the own- er of the record legal title to the min- ing claim. The lessee alone is not, or- dinarily, in a positon, under this see? tion of the-act, to apply for and pro- cure # relief lease, Sec. 18 of the act provides for the settlement and dis- position of two distinct classes of claims that are antagonistic or ad- ve which should be clearly distin-; ed. The section provides that in simants for leases case of conflicting c under this. section “the Secretary of the Interior is authorized to grant leases to one or more of them as shall be deemed just." This is followed by the further provision that “all leases hereunder shall inure to the benefit of the claimant and all persons claiming, through or under him by lease, con= tract, or other ¢, as their interests may xppear, subject, however, to the same limitation as to area and acreage as is provided for claimant in this sec- tior The first quotation refers to ad- ver and conflicting cliims to the same lind, that is to (say, adverse claimants u two or more different and antagonistic lines of title having a afferent origin; at is this class of ad- verse and conflicting claims that the Secretary of the Interior ity to settle and determine 6 But the has author rond quotation refers to the class of gases where bth parties are claiming the east half of section 12-39-79, | the same interests or claiming an in-) terest under the same title.
