Attorney es, Prosecutuion of All State Offenders CHEYENNE, Wyo., Aug. 27.—As- sistant United States Attorney David J, Howell stated today that the federal migratory bird protection act will be vigorously ‘uphdld in Wyoming ‘this year through the arrest and prosecu- tion of all offenders of whom the fed- eral authorities obtain information. Heretofore there has been no éffort in this state to epforcq this law, the inactivity of the federal authorit re- sulting from the fact that the courts of several states had held the federal act to be unconstitutional in its conflict qwith-state game laws. In April, 1920, however, the United States supreme court -held the migratory lird. law to be constitutional, and this decision means that it will be enforced: hereafter. Wyoming sportsmen -vho, having the state law in mind, were contemplating duck hunts Septeniber 1st, would bet- ter take second thought and postpone their first hynt until) September 16th. The open season on” ducks prescribed by the state law begins September 1st, but the federal migratory bird law] says that ducks shall not be hunted he- fore September 16th, and the federal law takes’ precedence of the state jnv. In other words, a hunter may kill wild ducks after September 1st without dan- &er_ef_prenecution by the state aythori- ties, but if he kills them before Septem- ber 16th he is in danger of prosecution by the federal authoritias. Under the federa! law, the open sea- s80n on ducks will close December 31st. The fowl may be hunted only during the period beginning one-half hour. be- fore sunrise and ending at sunset.
