Death of Judge Burgess Will Not Deter Democrats. Jefferson City, Mo., Dec. 19.—It was stated on official authority here to-day that the contests instituted by Democrats in the Supreme Court against four Republicans who were elected to the State offices last No- vember on the face of the returns will not be abandonded as the result of the death of Judge Burgess, but will be pushed. The contest will finally be heard and determined by five Judges of the Supreme Court—Judges Valliant, Woodson, Graves, Lamm and who- ever is appointed by Governor Hadley to succeed Judge Burgess. The Republican attorneys who at- tacked the contests filed by the Dem- ocrats on fifty-three specific grounds, may, in view of the changes wrought in the court since last Saturday, want to amend their replies and eliminate some of the grounds they set up in opposition to the contest petitions, for if they are right in their conten- tion that the present is an adjourned term of court, then, under Section 5951 of the Statutes, three Judges can try the issues. Republican lawyers have been contending that seven Judges would try these contest proceedings. They are assuming that Judges Kennish and Brown will be disqualified to sit; that two special Republican Judges can be selected, owing to the fact that the Republicans will have four out of seven members of the court after the first of the year.
