Mize purchased some stock in this bank and directed that it be issued to him as trustee for his daughters and youngest son, which was done He kept the cer- tificates of stock in his possession until he died, when D. C. Mize, as administrator sued the bank for the dividends on this stock, claiming that the stock was the property of his father end that he was entitled to it as administrator; the baak claiming that it was the property of the children, who were made parties on the application of the bank. The judgment of the court of appeals, it seems, sustains the position of the bank in this matter. D. C. Mize was represented by Francisco Bros., the bank by Thomas J. Smith, and the other children of Col. Mize by Boyd & Murrell of Marshall.
