Ist. and at the ex- piration of each succeeding five years thereaf- ter, by giving notice, in writing to & «ran- at least three months previous ira- and by paying valne of said works, Which val hall be determined frst by agreement between said city and eaid gran- tees and in case they cannot agree, then by arbitration, and if this proves unsatisfactory and they failto agree, then by the cireuit court of Bates county in the manner prescrib- ea by law, and upon such purchase and the payment thereof, the eaid grantees shall de- liver possession of said works, and this ordi- nance shall cease and become void. Sxction 12. Said grantees ehall have the right [exclusivelyj to tap mains and make all the needful rules and regulations for the pro- tection of said water-works and their opera- tion i supplying consumers with water for shutting off Water, for non-payment of water rates or waste of water, and to require and tix the penal sum of any bond for those who may en- gage in plumbing ‘and otherwise regulate the safé and efficient operation of the water-works. Sxction 13. In the operation of the water- works, unseen and unavoidable accidents may occur such as breakage of mains, of machinery of stand pipes, or by tornadoes or cyclones, or floods or cloud bursts, water spouts or light- ning, or labor troubles, or a malicious inter- ference and injury to the id works may be perpetrated, making it an impossibility to op- erate the said works to the tenor and effect as hereinbefore set forth; hindrance from any of the afor make a forfeiture of this ordinance or any of the provisions thereof provided that in good faith all such repairs and obstacles be as re made and overcome as porsible with due dilligence; and the hydrant rental shail cease during any euch time that said works are not in operation. Sxction 14.
