Payton, in- dicted tor murder, was found guilty by a jury, but the court reversed sen- tence. Last Saturday at Ozark Pay- ton’s attorneys argued a motion tora new trial before Judge Gregier, but the motion was overruled und Payton was sentenced tohang on the 28th t s of next month. The crime for which Payton, who 1s only 17 years old, is sentenced was committed about a year ago, at which time it is charged that he and his brother shot at a man named Bud Mathews, who was in a wagon with his family moving from Taney coun- ty to Chadwick. The shot missed Mathews and killed his two-year-old child Claudie. The house in which the Paytons lived had previously been shattered by giant powder and some of the family badly hurt, which they charged to Mathews, hence the at- tempt to take his life. The case of the other Payton boy is still pending in the circuit court at Ozark. Both the prisoners are confined in the jail in this city.
