Judge Grimson Will Sit on Case Brought by Devils Lake Attorney Arguments on a demurrer to the complaint in a test case brought in Ramsey county on validity of the de- feated 1935 income tax law will be heard at Rugby, Jan, 4, Assistant At- torney General T. A. Thompson said; Friday. Frederic T. Cuthbert, Devils Lake attorney, is contesting the state's right to collect unpaid 1935 income taxes on grounds the law was de- feated by voters in the 1936 primary | election, Thompson said. He explained arguments on the state’s demurrer will raise the legal question of whether the law was ef- fective from the time it was passed by the legislature until it was defeated by voters. Agreement to argue the case before District Judge Gudmundur Grimson at Rugby was reached with Attorney Clyde Duffy, Devils Lake, Cuthbert’s counsel, Thompson said. The action was brought after Sher- iff Bert Smutz of Ramsey county levied on Cuthbert’s law libray in an sttempt to collect the delinquent tax. ‘The case involves the state's right to collect $17,000 still outstanding in 1935 income taxes. She and the children were brought to Bismarck and placed in the Hillcrest home near the Country Club for three weeks. Get $45 a Month On Dec. 1, because the Farm Secur- ity check had not arrived, the Welfare Board gave the family a $4 grocery order. The check for $45 was mailed fzom Lincoln, Neb., on Nov. 30 and received by the mother a few days later, The Welfare Board provided hospital care for the woman when her new baby was born and when she left for the hospital the father was with the other children. After Dahlen’s report on conditions appeared in print a Welfare Board agent visited the woman in the hos- pital and she admitted that she had some money with which to buy sup- Nevertheless, when a child of the family applied for help and the Open Your Heart committee visited the home, conditions were as Dahlen de- scribed them. Rap Parental Indifference The answer, Young and Dahlen agreed, is indifference to the plight of the children, gross carelessness and mismanagement on the part of the parents. This imposes an additional burden upon both public and private relief agencies if the children are to be kept from suffering. Welfare Board records show that since Sept. 21, when the woman and children returned from Minnesota she has received in checks and relief or- ders $220. When the December Farm ; Security check is added to this the total is $265 for the period from Sept. 21 to Jan. 1. In addition to surplus food there also have been issued two mattresses, two quilts, six dresses, two overalls, two shirts, two bloomers and one slip. Dahlen’s suggestion to Young was that it would be both cheaper and bet- ter to take the children away from the parents, since they seem to lack a sense of responsibility and the child- ren will have small chance to develop into good citizens under such influ- ences and in such an environment.
