THE BISMARCK TRIBUNE, FRIDAY, MAY 28, 1937 Killed Wife as ‘Coup de Grace’ JUDGE'S DECISION ON ~AAATTAX REVERSED Jurist Erred in Awarding Bak- Ing Firm $13,929 Judg- ment, Court Holds St. Paul, May 28—(P)—The state me court Friday reversed a Hennepin county district court deci- ag granting a $13,929 judgment to Zinsmaster company rine the Commander Milling com- Pany, both of Minneapolis, in recov- ery of processing taxes. District Judge Levi M. Hall erred, the supreme court held, in striking out as “sham and frivolous” the de- fendant milling company's answer to the Zinsmaster complaint and in en- tering judgment for the full amount Gemanded. The Zinsmaster company charged that under the Agricultural Adjust- ment act, invalidated by the supreme court of the United States in 1936, it purchased 10,094 barrels of flour with @ tax of $1.38 on each. The money collected, it asserted, never was turn- ed over to the federal government. Because of a suit brought by tite milling company, the baking firm went on, the $13,929 tax collected on the flour was impounded and later refunded to the Commander com- pany when the act was declared un- constitutional. Melvin Vidrine, manacled above, didn’t murder his wife, Frozina, he explained to a jury in Ville Platte, La. He simply found her suffering from a sui- cide attempt and sdministered the coup de grace, he said. His Acadian relatives came to the old live oak-shaded courthouse to hear the defense testimony. Frozina’s kin came to hear the Prosecution. April, 1937. This compares with 71,- 449 passengers carried in April, last year. New Potatoes California Whites, NORTH POLE'S RADIO BEHAVIOR PUZZLES Communication Equipment of Aerial Explorers Fails to Function Property Moscow, May 28.— be- havior of radio waves at the earth’s axis puzzled Soviet Russia’s North Pole air lane explorers Friday. The academy of sciences at Moscow appointed 10 scientists and radio en- gineers to study disturbances which resulted in the failure of much ex- tensive equipment to operate at the weather outpost. Dr. Otto J, Schmidt's party camped on a polar ice floe found short wave transmission virtually impossible be- cause of “unexplained disturbances.” The camp was unable to receive radio reports from Pilot I. P. Mazuruk, 25 to 35 miles away. Failure of radio apparatus to per- form efficiently apparently was one of the reasons three supply planes flying to the outpost from Rudolf island Wednesday became separated.
