WEATHER'S EFFECT ON HAIL RISK LAWS FACES COURT TEST ~ Garmer Claims $600 on Insur- ance; Application Delayed by Railway Washout An “act of God” which delayed delivery of approximately $20,000 in hail insurance applications until after hail had destroyed crops in Adams and Bowman counties, is to be the focal point of a district court trial at Hettinger. © ‘Involved are claims from several score farmers in the two counties, whose applications they assert were on a train delayed by a washout, W. q. Austin, assistant attorney general, explained. Only one claim will be made the basis of a test suit, scheduled to be heard in Adams county district court late this week or early next week. Suit Against Hopton | John Hilden, Adams county farmer, brought suit against Harold Hopton, state hail insurance commissioner, to recover $600, which he claims rep- resénts damages to his crops by hail. Hilden, in his complaint, asserts he filed his insurance application with Mrs. E. M. Krause, county assessor, July 8, 1935, and that the application also was filed with L. M. Howell, Adams county auditor, July 9. He also asserts his application was mail- ed by Mrs. Krause, July 8. Records of the hail insurance de- partment show the application was Hot received until July 12. In the meantime, hail struck, and damaged Hilden’s crops on July 10. Austin explained the defendant in the action maintained his applica- tion was delayed by the washout which held up the train bearing the mail. To Test Law Austin, who will represent the state, explained the suit would test the question of whether the insur- ance commissioner may waive techni- calities of the law, which hold the application is not received until it reaches the office of the state hail insurance department, when an act of God intervenes. Also to be determined, Austin said, will be question of whether a post- ffice mail box maintained by the hail department, is an extension of the office. Conventions will be made, Austin expected, that the mail box consti- tutes a part of the hail insurance de- partment office, and that an appli- cation has been “received” officially when it is deposited in the box. Other claims in other sections of the state also hinge on the outcome of the suit, attaches of the hail in- surance department said. Scouters Not Taking Part in U. S. Simle, director of women’s recreation classes, an- nounced Thursday that during the state basketball tournament there will be no meetings of the classes, jwhich are held in the World War Memorial building. The morning classes are starting indoor tennis at next week’s sessions and anyone interested in the game is invited to come to the meetings from | 9:30 to 10.30 a, m., Monday, Wednes- day and Friday. Four new volleyball teams were or- ganized for a final round of tourna- ment play at this week’s meetings. Blanche Munson captains the Hi- Liners, Lois Simle the Torpedoes, Emma Mandt the Imps and Betty Barnes the Grape Nertz. The Hi-Liners played the Tor- pedoes, winning 37 to 25, and the Grape Nertz won from the Imps by 38 to 36. The Diggers basketball aggrega- tion captained by Miss Barnes played a team of St. Mary’s high school girls, the Diggers, winning 16 to 13. Tena Toftener’s Sky Rockets team played their second game with the Indian school and the Indian school girls again won, the score being 13 to 2. Next Monday evening, the Indian school will play the Diggers and the Wachter Sirens will play a combina- tion team called the Sky Rockets. TRIBUNE, STATE ASSOCIATION TO PUSH BURGUM'S CANDIDACY FORMED Jamestown Man Claims There Is Statewide Demand for Pastor to Run Jamestown, N. D., March 19.—(?)— A state association of Burgum-for- Governor clubs has been organized here with A. B. Demo, Jamestown, state chairman, and Noel Solien, Jamestown, as treasurer. An execu- tive secretary with headquarters will be selected later. Formation of the organization, Demo stated, is the “result of a state- wide response” to the suggestion that Rev. Leslie R. Burgum, Jamestown, Democratic leader in the state house of representatives last year, become @ candidate for governor. “Hundreds of letters have been re- ceived by Mr. Burgum during the last few weeks,” Demo said. “They come from citizens of almost every political affiliation as well as from many .who have never taken an active part in political affairs. From this group an executive committee composed of a member from each county of the state will be selected in the near future. “In Mr. Burgum, who is a member of the bar and pastor of the Metho-| dist church here, we feel that we have an able leader and one who brings the hunmanitarian philosoghy of the New Deal to the muddled waters of} .4 state politics and who will lead the fight for party responsible govern- ment,” Demo said. Va. March 19.—(#)— Capt. Orville Anderson, co-holder of the stratosphere record, was forced down near here in his plane Thurs- day. He was uninjured, but the plane was slightly damaged. WPA Runs Smoothly In N. D., Moodie Says ‘Washington, March 19. — (®%) — Thomas Moodie, North Dakota works Progress administrator, conferred Wednesday with federal work relief officials on matters he said were “purely administrative.” Moodie was one of several state ad- ministrators summoned for the dis- cussion. He did not ask an increase in his state’s WPA allocation. He described the work relief pro- gram in North Dakota as “running smoothly.” . 28 ROAD PROJECTS PORN. D. APPROVED Program Costing $675,962 Has Federal Okay; Will Help Cut Relief Load Approval of 28 highway projects in North Dakota under the federal work relief program totaling $675,962, was announced Thursday by the national emergency council. Construction on these projects will be started soon and will materially |reduce the relief load in the state by providing work for the unemployed, according to Cummins.
