Biological Survey is about to construct a dike across Long Lake between Sections 7 and 18 and between Sections 8 and 17, Wild Rose Township, Burleigh Coun- ty, ane WHEREAS, the said Biological Sur- vey has offered to construct the said dike sufficiently high so that it can be used for a public highway without expense to Burleigh County, except for furnishing an engineer and a cat- erpillar tractor, (OW, THEREFORE, BE IT RE- SOLVED by the Board of County Commissioners of Burleigh County, North Dakota, that in consideration for corstructing the said dike re- ferred to above by the said U. S. Bi- ological Survey, sufficiently high to allow of its use as a public highway, the said Burleigh County will furnish the use of one caterpillar tractor and an engineer to operate the same, with- out cost to said Biological Survey during the time of constructing the said dike, and during the construction of a dike in Section 23, T. 137. The following motion by Commissioner Lein: It that the delinquent personal property taxes of Emil Erickson for the years 1921 to 1929, inclusive, appear unpaid in the office of the Sheriff of this county, and satisfactory proof of pay- ment of the compromised amount thereof has been presented to this Board; now, therefore, said taxes are hereby considered to have been fully settled, and the proper county officials of this county are hereby authorized 20 cancel and discharge the said taxes of record in their offices. That upon and against the prop- erty aforenald there has been spread on the tax rolls of Burleigh County, tax charges against said property for the years 1930, 1931, 1932, and 1933, which, excluding the interest and Penalty, total the sum of $29,253.89. ‘That the current taxes for the year 1984, against the property hereinbe- fore described, is in the additional gum of $10,246.33. 5. That the whole of the tax obli tions aforesaid remain unpaid. such property has not been sold any purchaser other than the Coun- ty of Burleigh in the State of North Dakota, That while the property has depreciated in value the tax charges spread against such property have materially increased, That the valu- ations taken as a basis for tax charges were unwarranted, unjust and unequitble. That without going into detail the Patterson Hotel Co. asks that the Honorable Board, and the Tax Commissioner to whom this application and offer is directed, to refer to the tax rolls of the respec- tive years involved, which are here: by referred to and by whom this ref- erence made a part of this applica- tion, An investigation of the current 7 and prior tax rolls will disclose, among other things, the followin That while the tax trend was in geme eral downward as between the years 1930 and 1931, the tax obligations on Lots Five (5) and Six (6) in Block Forty-eight (48), were in 1930 ap- proximately the sum of $1,958.92, and in 1931 the tax obligations against Lots Five (5) and Six (6) in Block Forty-eight (48), were $1,823.97. That the tak obligations on Lota Seven (7) and Bight (3), in Block Forty-eight (48) in 1930’ were ap- proximately the sum of $6,633.14, while in the year 1931 the tax ob- ligations against the same property amounted to the sum of $6,618.47, in 1932 the sum of $5,093.43, and in 1933 the sum of $5,520.04. The foregoing is not intended as a complete states ment of the errors, over-assessments, and injustice of the tax obligation applied against the property ine volved, but on the contrary the fore- going ‘is referred to as a portion of the facts disclosed by the tax rec- ords covering such property, to which tax records reference is hereby made, and which ts Hkewlse made a part hereof. i That the counsel for this company, John F, Sullivan, and the State's At torney for Burlelgh County, Mr. George S. (g) That in addition to the $48,- 399.20, plus $162.38 hereinbefore pro- vided’ for, the owner will pay the additional sum of $10,246.33, on or he- fore the first day of December, 1936 the said sum being the full amount of the 1934 tax, exclusive of interest and penalty. (h)_ It is further understood and agreed that as payments ate made by the owner as aforesaid, that in- terim receipts will be issued by the County Treasurer to evidence such payments, and that regular tax re- ceipts shall be Issued as follows: (1) Upon payment of the sum of $20,000.00 cash the County Treas- urer shall be authorized and directed to issue a tax receipt for all bal- ances included in the tax compromise appeal and for all years included therein, and the State's Attorney shall be authorized and directed to execute a satisfaction of the judg- ment entered in gaid proceeding, and all proceedings therein in the Su- preme Court shall be dismissed, with- out costs to either party. (2) When. the full amount paid by the owner amounts to the sum of $24,000.00 the Treasurer shall issue a general tax receipt in full of the 1930 tax obligations as against the Property hereinbefore described.
