The case has never been pressed, however, because of a clause in the original agreement settling the taxes, subsequently upset. Under that agree- ment, $43,000 was paid to the county in cash. It was stipulated, however, that in the event the agreement was challenged or invalidated, the county must pay this money back. This the county has been and is unable to do. As a result an impasse has been reached and indications Friday were that all parties concerned were will- ing to settle if an agreement can be reached. Action Improbable case, however, it can contend that the law eliminating interest on de- linquent taxes does not apply since the Patterson taxes were reduced to judgment before the statute was en- acted. It appeared improbable, how- ever, that the county would take such @ stand. The case has been in and out of the courts for the last eight years and represents a dizzy whirl of legal and technical maneuvering. One phase of it was the action of the group of taxpayers in challenging the original compromise. Cox was the attorney for the protesting group in that ac- tion, and it was for this reason that Sullivan asked that he, or some other lattorney to be appointed by the group, be called into conference. He explained he wants no charges of subterfuge in the event an agreement is reached. The principal sum involved in the argument, Sullivan said, is some $9,500.
