HF - TUTTLE WILL CASE | HEARING SET HERE Daughter Wins Judgment Over , Deceased Father’s House. keeper in Steele Trial Steele, N. D., Aug. 2—The question of whether or not Ezra Conine, Tuttle, who died last year, was mentally competent when he drew up a will . leaving the bulk of his property to his housekeeper, Anna Kennedy, 69, was the subject of a case brought by his daughter, Mrs. Sylvia Seibels, Los An- geles, Calif. against Mrs. Kennedy, and tried in Steele with the verdict going to the plaintiff this week. The case is now pending on a mo- tion for judgement notwithstanding the verdict or a new trial and will come up before Judge Fred Jansonius in Bismarck about August 8, according to Chas. L..Crum, one of the attor- neys for Mrs. Kennedy. If the mo- . tion is denied the case will be ap- pealed to the state supreme court. F. E. Among the witnesses were Dr. H. A. Brandes, Bismarck, and Doctor Baer of Steele, called in to give pro- fessional opinion regarding the final illness of the deceased.
