D., Dec, 23—(P)— Berry Clare, Jamestown, who was brought before Judge F. L. Kellogg, justice of the peace, on a deer killing charge Tuesday afternoon, was bound. over to Stutsman county court when he pleaded not guilty to killing deer. His bond was fixedat $500, which was furnished, and the case set for Dec. 29. The case came before Judge Kellogg Saturday but was reopened Tuesday | on a point of jurisdiction of justice court in this matter. The penalty was in excess of justice court jurisdiction and the sentence of the justice court was set aside. Berry appeared with his attorney, F. G. Kneeland, and R. D. Chase, state's at- torney, was present. The arrest was made through the efforts of Al Dunn, deputy game warden. Inquest at Rugby Is Postponed Again Rugby, N. D., Dec. 23.—()—An in- quest into the death of Sig Nelson, farm laborer who was found dead in a barn near Wolford, was postponed ‘Wednesday pending a report -from laboratories at the University of North Dakota, Grand Forks, @here Nelson's viscera was sent for exam- ination. Sivert Armstrong, farmer near Wol- ford who witnesses said had partici- pated in a fight with Nelson late in September when Nelson was last seen alive, was being held for questioning. State’s Attorney Stanley S. Casey, said no charge has been placed against him pending the finding of the inquest.
